Chapter 5. Explosives
Sec. 3-5.01 Manufacturing, Keeping and Storing.
No person shall manufacture, keep or store any gun powder, Hercules powder, Giant powder, dynamite or other explosive substance in the City of Hercules in quantities exceeding fifty (50) pounds within one thousand (1,000) feet of any public road or highway, or main line of any steam or electric railway, or within a quarter of a mile of any public building or dwelling house, without the consent in writing of the owner of such dwelling house, unless such public road or highway or mainline of any steam or electric railroad, public building or dwelling house be effectually protected by a natural or artificial embankment, elevation or barricades of such height that every straight line drawn from any part of the building or buildings in which such explosive substance is kept or stored, passing over such natural or artificial embankment, elevation or barricade, will, if continued on in the same direction, also pass over the highway, railroad or building to be protected; provided that in no event shall any of the explosive substances above mentioned be manufactured, kept or stored within five hundred (500) feet of any such public road, or highway, or main line of any steam or electric railroad, public building or dwelling house.
Sec. 3-5.02 Protection of Railroad Car Loaded with Explosives.
Every railroad car, loaded wholly or partly with any of the explosive substance mentioned in this Chapter, while left standing on any railroad track within the City of Hercules, shall have a watchman constantly in charge thereof between the hours of sundown and sunrise of each day. Said watchman shall be provided and paid for by the owner of such explosive substances up to the time that any such car is wholly loaded, and thereafter and while such wholly loaded car is so left standing within the City of Hercules, said watchman shall be provided and paid for by the person or corporation furnishing said car.
