Chapter 13-41. Certificates of Occupancy
Sec. 13-41.100 Purpose.
To ensure that new or expanded uses of a structure or site and new structures or alterations of existing structures comply with all applicable provisions of the Zoning Ordinance and other applicable regulations of the City, and to provide the City with a record of each new or expanded use of a structure or site. Sec. 13-41.200 Requirements.
A certificate of occupancy is required before any structure or site may be occupied or used. No structure that is erected, moved, altered, or enlarged shall be occupied or used; and no site shall be initially occupied or used until a certificate of occupancy is issued by the Building Official. Sec. 13-41.300 Application Process.
Application for a certificate of occupancy shall be filed with the Building Official prior to the erection, moving, alteration or enlargement of any structure and prior to the commencement of a new use or a change of use of any structure or site. [Ord. 515 § 2, 2018; ZO § 41.300.]
Sec. 13-41.400 Issuance.
The Building Official shall issue a certificate of occupancy upon receipt of written notice that the structure or site is ready for occupancy or use and after he has inspected the structure or site; provided, that the structure or site and the intended use thereof conform with the regulations for the district in which it is located and all other applicable provisions of the Zoning Ordinance including conditions of approval that may be required for the property, structure or use.
