1.08.060    Severability.

1.08.010 County code – Adopted.

Pursuant to the provisions of Section 57376 of the Government Code of the state of California, all ordinances of the county of San Bernardino, codified in the San Bernardino County Code, and all other ordinances of the county of San Bernardino, theretofore applicable, are adopted as ordinances of the city of Highland and shall remain in full force and effect as city ordinances from the effective date of the ordinance codified in this chapter until the city council enacts ordinances superseding them. 1.08.020 Amendments to county ordinance.

The following amendments are made to the county of San Bernardino ordinances referenced in this chapter:

Whenever “board of supervisors” or “board” is used in the chapter, it means the Highland city council.

Whenever “county” is used in the chapter, it means the geographical limits of the city of Highland unless a different geographical area is clearly indicated by the context.

Whenever “county,” “county of San Bernardino” or “unincorporated territory of the county of San Bernardino” is used, it means the city of Highland. (Ord. 26 § 2, 1988)

1.08.030 No city ordinance shall be deemed to supersede any county ordinance.

No city ordinance enacted shall be deemed to supersede any county ordinance referenced in this chapter unless the city ordinance specifically refers thereto and states an intention to supersede it. (Ord. 26 § 3, 1988)

1.08.040 Interpretation of county ordinances as applied to the city.

In the ordinance code of the county of San Bernardino as adopted by reference, the reference in the code to an office, official title, or other designation means the corresponding office, title or designation in the governmental structure of the city. If there is no corresponding office, title or designation, then the reference means the office or person in the city who performs the function or duty referred to in the ordinance code adopted by reference. 1.08.050 Repeal of various titles, divisions, chapters and sections of the San Bernardino County Code.

The following provisions of the San Bernardino County Code, as adopted by this chapter, are repealed:

A. Title 1, Division 1, Chapter 2, not including Section 11.0208, which provisions shall only apply to Chapter 6.04 HMC;

B. Title 1, Division 1, Chapter 3, in its entirety;

C. Title 1, Division 2, in its entirety;

D. Title 1, Division 3, Sections 13.011 through 13.0655, in their entirety;

E. Title 1, Division 4, Chapter 2, in its entirety;

F. Title 1, Divisions 5, 6, 7, 8 and 9, in their entirety;

G. Title 2, Division 1, in its entirety;

H. Title 2, Division 4, Sections 24.021 through 24.023, in its entirety;

I. Title 2, Division 4, Section 24.031, in its entirety;

J. Title 2, Division 5, Section 25.012, in its entirety;

K. Title 2, Division 6, Sections 26.021 through 26.024, in their entirety;

L. Title 2, Division 7, Section 27.073, in its entirety;

M. Title 3, Division 1, not including Chapter 2, Section 31.0215;

N. Title 3, Division 2, in its entirety;

O. Title 4, Division 2, Chapter 5 commencing with Section 42.051, in its entirety;

P. Title 6, Division 3, Chapters 1 through 5 and 9, in their entirety;

1.08.060 Severability.

If any section, sentence, clause or phrase of this chapter is for any reason held to be invalid or unconstitutional by the decision of a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance. The city council of the city declares that it would have passed this chapter, and each section, subsection, clause, sentence or phrase thereof irrespective of the fact that any one or more other sections, subsections, clauses, sentences or phrases may be declared invalid or unconstitutional.
