TOBACCO VENDING MACHINES

9.12.010 Purpose.
This chapter shall regulate the sale of cigarettes through tobacco vending machines in order to protect the health and welfare of the general public. (Ord. 149 § 1, 1992)
9.12.020 Definitions.
As used in this chapter:
“Direct supervision” means within 15 feet and in direct line of sight of any occupied work station, including an occupied cash register station or food/beverage counter.
“Tobacco vending machine” means any machine or device designated for or used for the vending of cigarettes, cigars, tobacco, or tobacco products upon the insertion of coins, bills, trade checks or slugs. (Ord. 149 § 2, 1992)
9.12.030 Tobacco vending machines – Prohibited.
Cigarettes or other tobacco products sold, offered for sale, or distributed by or from a vending machine or other appliance, or any other device designed or used for vending machines shall only be permitted when the device is under the direct supervision, as defined in this chapter, of an employee of the premises upon which the machine, appliance or other device is located. 9.12.040 Violation – Penalty.
