STORAGE OF ABANDONED, DISCARDED OR UNUSED OBJECTS, JUNK OR TRASH ON PUBLIC STREETS AND RIGHTS-OF-WAY1

12.05.010 Definitions.

A. “Materials,” as used herein, shall mean, but not be limited to, abandoned, discarded or unused objects or equipment, including, but not limited to, lumber, metal, recyclables, scrap wood, vegetation, junk, trash or debris.

B. “Public street” shall mean any public thoroughfare, avenue, road, highway, boulevard, parkway, way, drive, lane, court or cul-de-sac, or easement providing the primary roadway to and egress from the property abutting thereon.

C. “Roadway” shall mean that portion of a public street which is improved, designed, or ordinarily used for vehicular travel, including public street shoulders and any area within the public right-of-way. (Ord. 227 § 3, 1998)

12.05.020 Storage of abandoned, discarded or unused objects, junk or trash prohibited on public streets, roadways, and in the public right-of-way.

The storage of abandoned, discarded or unused objects or equipment, lumber, recyclables, scrap wood, vegetation, junk, trash or debris (collectively referred to as “materials”), including, but not limited to, such storage in containers such as cardboard boxes, bags, vehicles, trailers, or mobile storage units or any other storage unit or medium, on public streets, roadways, or in the public right-of-way in a manner which makes such stored material visible to the public, for a period in excess of 48 hours, except as specifically permitted by city ordinance, is prohibited.
