9.64.010 Definitions.

A. “Emergency” is a sudden unforeseeable combination of circumstances which calls for immediate action.

B. “Loiter” means to idle, to loaf, to stand idly by or walk, drive or to ride about aimlessly.

C. A “minor” is anyone under 18 years of age.

D. A “public place” is any place or property except private property put to a nonpublic use. (Ord. 307 § 2, 1967).

9.64.020 Hours loitering prohibited.

Every minor is guilty of a misdemeanor who loiters in a public place or trespasses on private property during the following hours:

A. During the period of June 15th to September 15th from 12:00 midnight and sunrise of the following day, for each day Sunday through Saturday, inclusive;

B. During the period of September 15th through June 15th:

1. Ten p.m., and sunrise of the following day, for each day Sunday through Thursday, inclusive.

2. Twelve midnight, and sunrise of the following day, for each day Friday and Saturday. (Ord. 307 § 3, 1967).

9.64.030 Exceptions.

This chapter does not apply when:

A. A minor is accompanied by a parent, guardian or other person having legal care, custody or control;

B. A minor is accompanied by the minor’s spouse who is not a minor;

C. A minor is on an errand by authority of the parent, guardian or other person having legal care, custody or control;

D. A minor is participating in or reacting to an emergency situation;

E. A minor is engaged in a legitimate business, trade, occupation, or profession with the consent of parents, guardian or other person having legal care, custody or control;

F. A minor is attending or returning home forthwith by the most direct route from a meeting, entertainment, or recreational activity directed, supervised or sponsored by a governmental agency, adult service club, church group or school authority;

G. A minor is returning home forthwith by the most direct route from a public motion picture establishment. (Ord. 307 § 4, 1967).
