14.08.010 Purpose.

The city is aware of the problems associated with the enforcement of the Mobilehome Parks Act and related regulations of the California Administrative Code and therefore feels that it is in the best interest of the city to assume responsibility for the enforcement of the Mobilehome Parks Act and related regulations of the California Administrative Code. (Ord. 381 § 1, 1982).

14.08.020 Assumption of responsibility.

The city assumes responsibility for the enforcement of the California Health and Safety Code, Division 13, Part 2.1 (Mobilehome Parks Act) and related regulations of Title 25, California Administrative Code, within the city. (Ord. 381 § 1, 1982).

14.08.030 Designation of enforcement agency.

The building inspection division of the planning department of the county of Imperial is designated as the enforcement agency for the city. The building inspection division is directed to assign and provide the necessary qualified personnel to enforce the provisions of the Mobilehome Parks Act consistent with the state’s enforcement program. (Ord. 381 § 1, 1982).

14.08.040 Schedule of fees.

The schedule of fees contained within the Mobilehome Parks Act shall be applicable with the city to provide for the cost of administration and enforcement of the Mobilehome Parks Act. (Ord. 381 § 1, 1982).

14.08.050 Regulations governing mobile home parks.

This section sets forth regulations regarding mobile home parks. The city deems it necessary that every mobile home park under its jurisdiction will be maintained within the guidelines of the Mobilehome Parks Act. Specific objectives include maintaining open space for adequate light and ventilation and to reduce the possibility of fire, and, where necessary, to provide access for fire suppression, to provide adequate public utilities such as water, sewer, and other public requirements, and to promote public health, safety and general welfare, and to provide inspection services for the installation of mobile homes and accessory structures.

In order to attain these objectives, the city will, immediately upon approval of assumption of the responsibilities designated in this section, enforce these regulations, thereby assuring that all mobile home parks within the city are habitable residential areas. (Ord. 381 § 1, 1982).

14.08.060 Existing mobile home parks.

There exist within the boundaries of the city four mobile home parks with a combined total of approximately 222 mobile home spaces. The age of the parks range from 10 years to 40 years old. The majority of the mobile home parks are in fair to excellent condition, with less than 25 percent being in poor condition. All existing mobile home parks operate at or near 100 percent occupancy. (Ord. 381 § 1, 1982).

14.08.070 Objectives.

The objectives of the city in respect to its mobile home park program are to upgrade the poor parks within the city to a substantial level of compliance, to maintain the condition of the existing complying parks, and to provide a continual service of construction, maintenance and occupancy inspection. The program plan includes that each mobile home, mobile home lot and mobile home park shall be maintained in conformance with the applicable requirements of the Mobilehome Parks Act. (Ord. 381 § 1, 1982).

14.08.080 Forms.

The building inspection division of the planning department of the county of Imperial is directed to use forms for the annual permit to operate, mobile home installation, and certificate of occupancy as provided by the state of California or printed forms that are identical in size, form and content to those of the state of California. (Ord. 381 § 1, 1982).

14.08.090 Effective date of assumption of enforcement.

The effective date of assumption of enforcement shall be January 1, 1983, provided the building inspection division of the planning department of the county of Imperial does effectively demonstrate the capacity to make a mobile home installation inspection to the Department of Housing Community Development, State of California. (Ord. 381 § 1, 1982).
