16.52.010 Planning commission review.

A. Pursuant to Government Code Section 66426, a condominium development or condominium conversion shall be treated as a subdivision subject to the provisions of the Subdivision Map Act. In addition, such development or conversion shall comply with this title. The planning commission shall have review authority over condominium development and condominium conversions pursuant to Chapter 2.08 HMC and HMC Title 17.

B. Design considerations shall be governed by the standards set forth in Chapter 16.03 HMC.

C. A condominium project or conversion which creates four or less ownership units as defined in Civil Code Section 783 shall be treated as a minor subdivision pursuant to the provisions of this code; five or more separate units as defined in Civil Code Section 783 shall be treated as a major subdivision pursuant to the municipal code.
