DAMAGE OR INJURY TO HIGHWAYS, ROADS, AND BRIDGES

12.16.010 Unlawful to damage.
It shall be unlawful for any person, firm or corporation to operate, drive, transport or move or cause to be operated, driven, transported or moved any traction engine, tractor, vehicle, implement, tool, machinery, article, or building upon, along, over or across any city street, lane or alley in such a manner as to permit any edge, blade, disc, share, tooth, block, stud, flange, cleat, ridge, bead or any other protuberance of metal or wood thereof to gouge, scratch, cut into, dig up, scarify, injure or destroy any of the graded, improved, paved or oiled surface of said public road, lane or alley. It shall be unlawful for any person, firm or corporation to operate, drive, transport or move, or cause to be operated, driven, transported or moved any traction engine, tractor or vehicle along, upon, over or across any city street, road, lane or alley in the city, when said traction engine, tractor or vehicle shall have on the periphery of its tires, tracks or wheels any unguarded and unprotected block, stud, flange, cleat, ridge, bead or any other protuberance of metal or wood which projects beyond the tread of the traction surface of the tires, track or wheels of said traction engine, tractor or vehicle. It shall be unlawful for any person to intentionally or negligently cause damage to any highway, road or bridge by any other means including but not limited to the discharge of water, chemical substances, waste materials, or any combination thereof. 12.16.020 Nonapplicability.
None of the provisions of this chapter shall apply to any person, firm or corporation or his, her, its or their agents or employees engaged in the repair, rebuilding or construction of city streets, lanes or alleys, while acting under competent authority in charge of said city streets, lanes or alleys, nor shall this chapter apply to any traction engine, tractor or vehicle, implement, tool, machinery, article or building when the same is operated, driven, transported or moved upon, along, over or across any city street, road, lane or alley, in strict compliance with the express written consent of the police department of the city or some member of said police department.
