9-82.010 Purpose and intent.
The purpose and intent of this chapter is to provide regulations for the siting of permitted waste management facilities. (Ord. 98-8 § 2 (part): prior code § 9-39.010)
9-82.020 Legislative requirements.
Waste management is governed by state and federal law. The licensing, inspection, permitting, and clearances are administered by the Orange County Health Care Agency (Environmental Health Division) and the Orange County Fire Authority. The city cooperates with local, state, and federal agencies to regulate the waste management stream. (Ord. 98-8 § 2 (part): prior code § 9-39.020)
9-82.030 Source reduction and recycling element.
The city has adopted a source reduction and recycling element establishing waste diversion goals to meet the California Integrated Waste Management Act requirements. (Ord. 98-8 § 2 (part): prior code § 9-39.030)
9-82.040 Household hazardous waste element.
The city has adopted a household hazardous waste element which identifies a program for the collection, recycling, treatment, and disposal of hazardous wastes generated from households which should be separated from the solid waste stream. Administrative operations for the city include participation in the county of Orange program with other cities or implementation of its own program. (Ord. 98-8 § 2 (part): prior code § 9-39.040)
9-82.050 Disposal limited.
The disposal of household hazardous waste in landfill facilities, sewers, and/or stormdrains is prohibited by state law and Chapter 5-44 of this code. (Ord. 98-8 § 2 (part): prior code § 9-39.050)
9-82.060 Hazardous waste.
Hazardous waste is found throughout every community. It is generated by a variety of uses including, but not limited to, medical centers, manufacturing businesses, dry cleaners, automotive businesses, photo labs, medical services, grocery stores, and pool supply houses. The Orange County Health Agency (Environmental Health Division) and Orange County Fire Authority administer the state programs regulating hazardous waste within the city. 9-82.070 Permitted waste management facilities.
Up to four reverse vending machines are permitted as an accessory use to a grocery store. Recycling centers, and four to eight reverse vending machines are permitted subject to a conditional use permit in all commercial, mixed use, industrial, and institutional zones. Periodic recycling events will be permitted subject to a temporary use permit. Waste transfer stations are permitted subject to a conditional use permit in the mixed use zone. All other waste management facilities are prohibited. (Ord. 98-8 § 2 (part): prior code § 9-39.070)
9-82.080 Facility siting criteria.
All permanent and temporary waste management facility sites shall be located in commercial, mixed use, industrial, and institutional zones and shall be subject to the development standards of the base zone, Fire Code requirements, Building and Safety Code requirements, and the following standards.
A. General waste management facility site criteria:
1. Waste management facilities shall not be located in one hundred (100) year flood inundation areas or areas subject to flash floods and debris flows.
2. Waste management facilities shall be located to keep the distances traveled on minor surface streets to a minimum.
3. Waste management facilities shall not be located in areas deemed to have recreation, cultural, and/or aesthetic value by the Community Development Director.
4. Waste management facilities shall be consistent with all the requirements of the general plan.
B. Recycling center facility site criteria:
1. Recycling facilities shall not be located within three hundred (300) feet of a residential zone.
2. Recycling facilities shall not be located in existing parking stalls or setback areas.
3. Recycling facilities shall be clean and litter free.
4. Recycling facilities shall be attended during the hours of operation which shall be limited to eight a.m. to five p.m. daily.
5. Temporary recycling facilities (i.e., portable recycling centers) shall not exceed a height of twelve (12) feet.
6. Waste transfer stations may operate between the hours of six a.m. to ten p.m. daily, provided all operations related to dumping, sorting, and reloading occur within a totally enclosed building.
C. Reverse vending machine site criteria:
1. Clusters of no more than eight machines shall be permitted per site.
2. The placement of the machines must be integrated into the existing site design.
3. Placement of machines in parking stalls or setbacks is prohibited. (Ord. 98-8 § 2 (part): prior code § 9-39.080)
9-82.090 Limitations.
No building permits may be issued to any waste management facility emitting any air contaminant until the state agency, with jurisdiction, has certified to the permit issuing authority that the appropriate state permits have been received by the developer, or that the developer will be eligible to receive such permits and that the development is otherwise in compliance with applicable air pollution laws. All waste management facilities shall adhere to adopted water/drainage protection requirements. (Ord. 98-8 § 2 (part): prior code § 9-39.090)
