3-3.1 Administration and Enforcement.
The Chief of Police is authorized and empowered to administer the provisions of this section and all police officers are charged with the duty of enforcing the provisions of this section. (Code 1972 §7-1)
3-3.2 Action of the Chief of Police Is Final.
The action of the Chief of Police as to the provisions of this section shall be conclusive and final. (Code 1972 §7-2)
3-3.3 Reports by Persons in Business of Selling Bicycles.
All persons engaged in the business of selling new and secondhand bicycles shall make a weekly report to the Chief of Police, giving a list of all sales made by the dealers, the kind of bicycle sold, together with a description and frame number of the bicycle, and the number of the license decal attached to the bicycle, if any. (Code 1972 §7-3)
3-3.4 Reports by Persons in Business of Buying Secondhand Bicycles; Retention of Secondhand Bicycles.
a. All persons engaged in the business of buying secondhand bicycles are required to make a weekly report to the Chief of Police, giving the name and address of the person from whom each bicycle is purchased, the description of each bicycle purchased, the frame number of each bicycle, and the number of the license decal found on the bicycle, if any.
b. All persons purchasing secondhand bicycles shall retain the bicycles in their possession for a period of ten (10) days. (Code 1972 §7-4)
3-3.5 Report Of Dismantling Of Bicycle:
Within ten (10) days after any bicycle registered according to this Section shall have been dismantled and taken out of operation, notice of that fact shall be reported to the Chief of Police by the person in whose name the bicycle has been registered. (Code 1972 §7-5)
3-3.6 Inspections And Equipment Requirements For Persons Renting Bicycles:
a. It shall be the duty of the Chief of Police to make periodic inspections of bicycles offered for rental by all persons engaged in the business of renting bicycles to the public.
b. All persons engaged in the business of renting bicycles shall be responsible for the condition of all bicycles offered for rental by them and also shall be responsible for equipping the bicycles with proper lights and other safety equipment as required by State law. (Code 1972 §7-6)
3-3.7 Prohibited Acts:
a. To Be Ridden Single File: No person shall ride a bicycle upon any street or other public highway in the City while maintaining a riding position abreast of any other person riding a bicycle, but must ride at a safe and proper distance behind the other.
b. Operation On Sidewalks: No person shall ride a bicycle on the sidewalks of the City.
c. Exemption: Any peace officer operating a bicycle in the course of performing law enforcement services is exempt from the prohibitions set forth above in subsections a and b.
d. Mutilation Or Removal Of Means Of Identification: It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this Section. It shall also be unlawful for any person to remove, destroy, mutilate or alter any license decal or registration card issued pursuant to this Section during the time in which the license decal or registration card is operative; however, nothing in this Section shall prohibit the Chief of Police from stamping numbers on the frames of bicycles on which no serial number can be found or on which the number is illegible or insufficient for identification purposes. 3-3.8 Duty Of Parents, Guardians Or Employees:
The parent of any child, the guardian of any ward or any employer shall not authorize or knowingly permit any child, ward or employee to violate any of the provisions of this Section. (Code 1972 §7-10)
3-3.9 Licenses:
a. Required: It shall be unlawful for any person to operate or use a bicycle upon any of the streets, alleys or public highways of the City without first obtaining from the Chief of Police a license therefor.
b. Scope Of License: A license required by this Section, when issued, shall entitle the licensee to operate a bicycle for which the license was issued upon all the streets, alleys and public highways, exclusive of the sidewalks, in the City.
c. Issuance Of License Decals And Registration Cards; Attaching Decal To Bicycle: The City shall provide each year numbered decals together with registration cards, the decals and registration cards having numbers printed thereon in numerical order, beginning with number one, and indicating the years for which they are issued, and the letters “L.B.L.” printed on them. The license decals shall be suitable for attachment upon the bicycles and it shall be the duty of the Chief of Police to attach one decal to each bicycle licensed pursuant to this Section and to issue a corresponding registration card to each licensee upon the payment of the license fee provided for in this Section. The license decal shall remain attached to this licensed bicycle during the existence of the license.
d. License Fee; Amount, Waiver: The fee for a license required by this Section to be paid for a three (3) year term shall be one dollar ($1.00). All license fees shall be paid in advance and pursuant to this Section. In the event that the Chief of Police or other officer charged with the responsibility of administering this Section determines that a waiver of the license fee will aid substantially in the licensing of bicycles pursuant hereto, he may waive the fee with respect to all applications received during such periods of time as he may from time to time establish.
e. Record: The Chief of Police shall keep a record of the date of issuance of each license pursuant to this Subsection, to whom it was issued, the license number and the number of the bicycle frame.
f. Duration: The Chief of Police shall issue, upon written application, a license required by this Subsection, which shall be effective from January 1, 1956 to and including December 31, 1959, and thereafter the licenses shall be issued for a term of three (3) years commencing on January 1, and ending on the last day of December of the third year of the term.
g. Operator to Carry Registration Card. The operator of a bicycle on any street or highway in the City shall carry on his person the registration card issued pursuant to this subsection and shall produce the card for inspection wherever it may be demanded by the Chief of Police or any police officer or other person duly authorized to demand its production.
h. Report of Sale or Transfer; Transfer of License. It shall be the duty of each person who sells or transfers ownership of any bicycle to report the sale or transfer within ten (10) days thereafter by returning to the Chief of Police the registration card issued pursuant to this subsection to the person as licensee together with the name and address of the person to whom the bicycle was sold or transferred. It shall be the duty of the purchaser or transferee of the bicycle to apply for a transfer of the license within ten (10) days of the sale or transfer of the bicycle.
i. Fee for Transfer of License. The fee for a transfer of a license issued pursuant to this subsection shall be one ($1.00) dollar.
j. Renewal. The Chief of Police shall affix a new license decal upon each bicycle at the time of the renewal of a license issued pursuant to this subsection.
k. Revocation.
1. The Chief of Police is empowered to suspend or revoke any license issued under the provisions of this subsection for any violation of the provisions of this section or of any applicable provisions of this Code or other ordinances of the City relating to street traffic.
2. No license required by this subsection shall be issued to or for any person who has had a license revoked until the expiration of one (1) year from the date of revocation.

3-3.10 Impoundment of Bicycles.
The Chief of Police is empowered to impound any unlicensed or improperly licensed bicycle. (Code 1972 §7-33)
