Article I. General Provisions

4.05.010 Short title.

This chapter may be cited as “Sanitary District No. 5 of Marin County sewer service charge ordinance.” [Ord. 78-1 § 1.1.]

4.05.020 Definitions.

Unless the context otherwise indicates, terms used herein have the following meanings:

“District” means Sanitary District No. 5 of Marin County.

“EDU” or “equivalent dwelling unit” means the volume of wastewater flow produced by an average single-family dwelling unit and which wastewater is of a composition or strength usually produced from domestic use and which wastewater flows peak and ebb at the usual times of the day as the result of being produced from domestic use.

“Sewer service charges” means fees, tolls, rates, rentals or other charges for services and facilities furnished by District in connection with its sanitary sewerage systems.

“Single-family dwelling unit” shall mean the place of residence for a single family. Property improved for multifamily use shall be assigned the number of units that the structure(s) thereon provide in number of facilities for single-family use. [Ord. 78-1 § 1.2.]

Article II. Sewer Service Charges

4.05.030 Rate schedule.

Annual sewer service charge for the users below shall be as follows:

(1) Residential Sewer Service Charges. The annual sewer service charge payable by each single-family dwelling unit (one EDU), exclusive of hotels and inns, shall be as follows:

(f) The following definitions shall apply to the residential sewer service charges above:

(i) “Base rate parcel” means a parcel that is located in a jurisdiction that does not contribute property tax revenues to SD No. 5.

(ii) “Ad-valorem credited parcel” means a parcel that is located in a jurisdiction that does contribute property tax revenues to SD No. 5.

(2) Nonresidential Use (Includes Hotels and Inns). The annual sewer service charge payable for each nonresidential customer shall be calculated based upon the following:

(a) Nonresidential users shall be assessed a sewer service charge based upon annual metered water readings and wastewater strengths. A strength factor (EDU factor) will be used to recover costs for wastewater strengths greater than residential wastewater strengths. The nonresidential use groups and EDU factors are as follows:

* Any use not listed herein shall be assigned the most appropriate/similar of the above EDU factors by SD No. 5.

(b) The formulae used to calculate the annual sewer service charge for each nonresidential user shall be the following:

(i) (Annual flow x EDU factor) ÷ annual residential flow per EDU = nonresidential EDU units.

(ii) Nonresidential EDU units x annual rate = annual nonresidential sewer service charge.

(c) The following definitions shall apply to the nonresidential sewer service charge formulae contained in subsection (2)(b) of this section:

(i) “Annual flow” means the total volume of water utilized by a commercial property in the previous calendar year as calculated by the Marin Municipal Water District (“MMWD”) meter reading for the property, excluding any MMWD meters designated, or proven to be, only for irrigation purposes or other uses not resulting in water entering the SD No. 5 collection system.

(ii) Annual Residential Flow per EDU. The annual residential flow per EDU is assumed to be 7,500 cubic feet (HCF). This is the historic average for single-family home and duplex water meters in Southern Marin for the previous calendar year as provided by MMWD, but excluding one-third to account for water consumption used for irrigation purposes.

(d) The annual rate for use in the calculation of the nonresidential sewer service charge shall be set as follows:

(e) The following definitions shall apply to the residential sewer service charges above:

(i) “Base rate parcel” means a parcel that is located in a jurisdiction that does not contribute property tax revenues to SD No. 5.

(ii) “Ad-valorem credited parcel” means a parcel that is located in a jurisdiction that does contribute property tax revenues to SD No. 5.

(f) For all nonresidential users, the minimum sewer service charge shall be one EDU per parcel.

(3) Sewer Service Charge Collection Costs. An additional charge of $2.00 shall continue to be collected by the County of Marin in addition to each of the above residential and nonresidential sewer service charges and used for the purpose of defraying the costs of levying, collecting, and enforcing said charges on each lot or parcel of land against which a charge has been imposed.

For the purposes of the ordinance of which this section is a part, each improved property shall be deemed to be fully and continuously occupied as of July 1, 1978. Each property improved after July 1, 1978, shall be deemed to be fully and continuously occupied from and after the date of initial occupancy of any one unit thereof. 4.05.060 Paradise sewer line extension fee.

(1) SD5 hereby establishes and shall collect a “sewer line extension fee” from the owner of each parcel who desires to connect to the line. The amount of the sewer line extension fee shall be $10,000 for any connections that take place in the first 365 days following the effective date of the resolution codified in this section. The sewer line extension fee shall then be adjusted annually in an amount determined by the change in the Consumer Price Index for San Francisco-Oakland-San Jose, CA. The sewer line extension fee is separate and apart from any and all other fees that are, or may in the future be, charged by SD5 in order to connect to the line, including but not limited to any connection fee(s) based on a fixture count, annexation fees, and/or any other fees relating to connecting to the line.

(2) The 10 individual homeowners, as well as all of the 30 homeowners within Seafirth, who each already paid $10,000 to PDSE in anticipation of connecting to the line, shall receive a $10,000 credit towards the sewer line extension fee in the event they seek to connect to the line. [Res. 2009-1.]

4.05.070 Use of revenues.

Revenues derived under this chapter shall be used only for the acquisition, construction or reconstruction, maintenance and operation of sanitation or sewerage facilities of the District and to repay principal and interest on bonds issued for the construction of such sanitary or sewerage facilities and to repay Federal or State loans or advances made to the District for the construction or reconstruction of sanitary or sewerage facilities; provided, however, that such revenue shall not be used for the acquisition or construction of new local street sewers or laterals, as distinguished from main trunk, interceptor and outfall sewers.
