16.70.010 Boating prohibited—Exception.

It is unlawful for any person, firm, partnership, or corporation, except the city for maintenance purposes, to launch, place, or operate any watercraft of any description powered by an internal combustion engine in the Ellis and East Lakes located in the city except as follows:

(a)    For watercraft designed and intended for human conveyance, by special permit granted by the city manager or designee.

(b)    For radio-controlled gas or nitro-methane fueled power model watercraft not designed nor intended for human conveyance, not exceeding twenty-eight inches in length, when equipped with an electronic "fail safe" installed to prevent loss of control. 16.70.020 Use of electric motor propulsion permitted.

In order to promote greater recreational use and enjoyment of the city’s lakes, use of electric motor-driven watercraft for noncommercial purposes is permitted in the Ellis and East Lakes during daylight hours, defined to be from thirty minutes after sunrise until thirty minutes before sunset; provided, however, that no electric motor used for propulsion as otherwise permitted by this section may exceed a manufacturer’s rated output capacity of one hundred forty-five pounds of thrust. 16.70.030 Maximum speed limit.

The maximum allowable speed of any motorized watercraft operating upon the waters of Ellis Lake or East Lake, except by special permit, is five miles per hour (MPH) at all times and under all conditions. (Ord. 1373 § 2 (part), 2015).

16.70.040 Penalty.

Violation of this chapter shall be an infraction punishable by:

(a)    A fine of one hundred fifty dollars for a first violation.

(b)    A fine of two hundred fifty dollars for a second violation of the same provision within one year.

(c)    A fine not exceeding five hundred dollars for each additional violation of the same provision within one year. (Ord. 1373 § 2 (part), 2015).
