Article 1. GOVERNING PRINCIPLES

100 Purpose.

This Chapter contains a portion of the general policies and rules of interpretation pertaining to the operations of the City Council of the City of Marysville and to the official conduct of its members.

101 Marysville City Government. Existence. Form of Government.

The City of Marysville is a Body Corporate and Politic and as such has all rights and powers of local self-government, general or special, governmental or proprietary, which are now, or hereafter may be, possessed under the Constitution of the United States, and the Constitution and laws of the state of California.

102 Marysville City Government. Separation of Powers.

There is a separation between the legislative and administrative functions of Marysville city government, whereby the establishment and adoption of policy shall be the responsibility of the City Council and the execution of that policy shall be the responsibility of the Administration.

103 Marysville City Government. Legislative Branch.

The legislative power of the City of Marysville is vested in the elected City Council, the duties of which, and the compensation, terms of office, and electoral qualifications of whose members, are established by the Marysville Charter and state law.

104 Marysville City Government. Administrative Branch.

The administrative responsibility of Marysville City Government is vested in the Administrative branch, which shall consist of the City Manager, and such employees, officers, agencies, departments, divisions, offices and bureaus as are established from time to time pursuant to the Marysville Municipal Code.

105 Definitions.

The following terms and phrases when used in this Title shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning.

(a)    "City Council" or "Council" means the duly-elected City Council of the City of Marysville.

(b)    "Member" when used alone means a member of the City Council.

Article 2. COUNCIL MEETINGS

125 Regular Meetings.

The City Council shall hold regular meetings on the first and third Tuesdays of each month; provided, however, that by vote of the Council, regular meeting schedules may be modified to accommodate holidays or other circumstances acceptable to the Council.

(a)    Regular meetings of the City Council shall begin at 7:00 p.m.

126 Special Meetings. Adjournment to.

At any regular meeting or special meeting of the City Council, the Council may be adjourned to a special meeting whose date, hour, place and purpose are announced by the mayor or other presiding officer at the time of adjournment, whereupon the City Clerk shall prepare an agenda for such special meeting describing the purpose, and no other business shall be transacted at such special meeting.

127 Special Meetings.

On the Call of the Mayor or Council Majority. Special meetings of the City Council may be held on the call of the Mayor or of a majority of members of the whole Council upon not less than twenty-four hours effective notice to each member.

(a)    Whenever a special meeting is called pursuant to this section, the City Clerk shall be immediately notified and shall forthwith serve either oral or written notice upon each member of the Council, the City Manager and City Attorney, stating the date, hour and place of the meeting and the purpose for which it is called, and no other business shall be transacted at the meeting.

(1)    If, after reasonable diligence, it is impossible to give notice to each member, such failure shall not affect the legality of the special meeting if a quorum of the whole Council is in attendance.

(2)    The minutes of each special meeting shall state the manner and method by which notice of such special meeting was given to each member of the Council.

128 Emergency Meetings.

Emergency meetings of the City Council may be held at any time on the call of the Mayor upon effective notice to each member, all in conformity with government code section 54956.

(a)    Whenever such emergency meeting is called, the City Clerk shall be notified, who shall forthwith serve either oral or written notice upon each member of the Council, the City Manager and City Attorney, stating the date, hour and place of the meeting and the purpose for which it is called, and no other business shall be transacted at the meeting.

(1)    If, after reasonable diligence, it is impossible to give notice to each member, such failure shall not affect the legality of the emergency meeting if a quorum of the whole Council is in attendance.

(2)    The minutes of each emergency meeting shall state the manner and method by which notice of such emergency meeting was given to each member of the Council

129 Effective Notice of Special Meetings, Emergency Meetings.

Where notice of special or emergency meetings of the Council is required by this Article, effective notice shall consist of personal notice to the designated recipients or, if personal notice cannot be effected, by delivery to the recipient’s electronic mail account or his/her office and home.

(a)    It shall be the responsibility of the City Clerk to notify all local media outlets by telephone or electronic mail, if possible, and by posting of a suitable notice announcing the date, time, place, and matter(s) to be discussed on a public bulletin board reserved for such notices in the Marysville City Hall or other public place as soon as practicable.

130 Place of Meetings. Open to Public.

All meetings shall be held in the Council Chambers of the Marysville City Hall or such other place within the corporate limits of Marysville as may be approved by motion adopted at a meeting by a majority of the Council members present or, for emergency meetings, at the place designated by the Mayor, and shall be open to the public and all local news media, except as otherwise permitted by law or policy.

(a)    At any regular meeting or special meeting called for that purpose, the City Council may hold executive session which shall be closed to the public, for the purpose of considering those matters permitted by law.

131 Cancellation of Meetings.

Scheduled meetings may be canceled by a majority vote of members present at a meeting of the Council.
