Pursuant to Section 19 of Article IV of the State Constitution and Cal. Penal Code § 326.5, bingo games may be conducted within the City of Mt. Shasta by and exclusively for the benefit of organizations exempted from the payment of the bank and corporation tax by Cal. Rev. and Tax. Code § 23701d, and a contribution or gift to which would be a charitable contribution under Section 170(c)(2) of the Internal Revenue Code of 1954, provided such organizations comply with the following provisions in connection with the conduct of such bingo game:
(A) No person shall receive a wage or salary from any bingo game conducted pursuant to this chapter.
(B) No minors shall be allowed to participate in any bingo game conducted pursuant to this chapter.
(C) Any such bingo game shall be conducted only on property owned or leased by the qualifying organization, and such property must be used also by such organization either for an office or for performance of the purposes for which the organization is primarily organized.
(D) All bingo games shall be open to the public, not just to the members of the nonprofit charitable organization.
(E) Any bingo game operated pursuant to this chapter shall be operated and staffed only by members of the organization which organized it. Such members shall not receive a profit, wage or salary from any bingo game, or for their services in connection with any aspect thereof.
(F) Only the organization authorized to conduct a bingo game shall operate such game or participate in the promotion, supervision or any other phase of such game.
(G) No individual corporation, partnership, or other legal entity except the organization authorized to conduct a bingo game shall hold a financial interest in the conduct of such bingo game.
(H) All profits derived from a bingo game shall be kept in a special fund or account and shall not be commingled with any other fund or account.
(I) No person shall be allowed to participate in a bingo game unless the person is physically present at the time and place in which the bingo game is being conducted.
(J) The total value of prizes awarded during the conduct of any bingo games shall not exceed $250.00 in cash or kind, or both, for each separate game which is held. (Ord. 343 § 1, 1977)
5.52.020 Permit required – Application – License fee.
Any qualifying nonprofit charitable organization desiring to conduct a bingo game pursuant to the provisions of this chapter shall file an application for a permit for such game with the City Clerk on a form prescribed by such Clerk. By resolution hereafter, the City Council may impose a license fee to accompany such application in a sum not to exceed the actual cost of the issuance of the permit. (Ord. 343 § 2, 1977)
