17.04.010 Purpose.
The purpose of this title, and any rules, regulations, and specifications adopted pursuant thereto, is to control and regulate the division of land within the city and such land as may be annexed to the city. (Ord. 233 Sec. 1.1, 1972)
17.04.020 Authority--Short title.
Pursuant to the authority conferred Division 2 of Title 7 of the Government Code of the state of California, referred to herein as the “Subdivision Map Act” and in addition to any other regulations provided by law, the regulations hereinafter in this title contained are established herewith and shall apply to all divisions of land hereafter made entirely or partially within the city and to the preparation of maps thereof and for the filing and approval thereof; and this title shall be known as the land division ordinance. 17.04.030 Advisory agency.
The planning commission, as herein defined, is designated as the advisory agency, as that term is used in the “Subdivision Map Act,” and is charged with the duty of making investigations and reports on the design and improvements of all proposed divisions of land and is authorized to report in writing to the city council on tentative maps of land divisions prepared and filed according to the provisions of this title and the Subdivision Map Act. The report shall recommend approval, conditional approval, or disapproval of the tentative map and shall specify the kinds, nature, and extent of improvements required to be installed in land divisions. 17.04.040 Compliance required.
It is unlawful for any individual, firm, association, syndicate, co-partnership, corporation, trust, or any other legal entity, as principle, agent, or otherwise to sell or offer to sell by contract or otherwise either at present or in the future any division of land or any part thereof in the city unless and until all of the requirements of this title, and all amendments subsequent thereto, have been complied with.
