OFFENSES AGAINST PUBLIC PEACE

9.16.010 Interference with the use of property open to the public.
(A) It is unlawful for any person to loiter or to stand or sit in or at the entrance of any church, hall, theater or place of public assemblage so as in any manner to obstruct such entrance.
(B) No person shall loiter in or about any public building, park or recreation facility including any transportation facility in a manner and under circumstances manifesting the purpose to engage in acts of misconduct including, but not limited to, exhibitionism, solicitation, malicious mischief, or acts of indecent exposure. 9.16.020 Interference with public transportation.
(A) Annoyance. No person shall, with the intent of causing public inconvenience, annoyance, or alarm, or recklessly creating a risk thereof, within or near any public transportation vehicle, building or facility:
(1) Engage in fighting, or violent, tumultuous, or threatening behavior;
(2) Make excessive and unnecessary noise;
(3) Use abusive, obscene, profane, or vulgar language, or make obscene gestures;
(4) Obstruct the free unimpeded movement of passengers or public transportation vehicles; or
(5) Interfere with the duties of any maintenance or facility operations personnel, transportation vehicle operator, fare collector or inspector, or public safety officer, security guard or official.
(B) Failure to Obey Reasonable Requests. No person shall fail to obey a reasonable request or lawful directive of a transportation vehicle operator, public safety officer, or other person in charge or control of a public transportation vehicle or public transportation facility.
(C) Graffiti. No person shall cause graffiti, signs or stickers to be inscribed, applied, or affixed on any public transportation vehicle or facility.
(D) Restroom Facilities. No person shall deface, destroy, litter in, or otherwise misuse the restroom facilities located at any public transportation building or facility. (Ord. 1316 § 1, 2007; Ord. 10 §§ 5, 6, 1962)
9.16.030 Trespass on public property.
(A) No unauthorized person shall enter or remain unlawfully in or upon a public property, public transportation vehicle or public transportation facility or portion thereof when the premises or any portion thereof is not open to the public.
(B) No person may enter or use any public park, public transportation vehicle, public transportation facility, or other City property with intent to cause annoyance or injury to any person, to cause damage to any property, to commit any crime, or with reckless disregard as to whether his or her presence will cause fear for the safety of another. 9.16.040 Throwing missiles.
It is unlawful for any person to throw upon, along, or across any public highway, road, street, alley, or sidewalk any missile, projectile, or rock capable of causing personal injury or damage to personal property at or towards any person, or any vehicle. 9.16.050 Fighting in public prohibited.
It is unlawful for any person to engage in any physical fight, disorderly conduct, or altercation with any other person on any public property or upon the premises of another within the City, while in public view. (Ord. 1634 § 24, 2024)
9.16.060 Fighting on public property prohibited.
It is unlawful for any person to engage in any physical fight, disorderly conduct, or altercation with any other person on any public property or upon any public premises owned or operated by the City. (Ord. 1634 § 25, 2024)
9.16.070 Enforcement.
The City is authorized to take such actions as may be required for enforcement of this Chapter. The City may enforce any violation of this Chapter by any and all means available by law, including, but not limited to, civil enforcement through such means as a restraining order and nuisance abatement action for relief such as preliminary or permanent injunction, criminal enforcement, and administrative enforcement. These remedies are intended to be cumulative and may be used in conjunction with or in lieu of each other remedy. (Ord. 1634 § 26, 2024)
9.16.080 Public nuisance.
Any violation of this Chapter shall constitute a public nuisance subject to abatement procedures prescribed in PMC Chapter 8.36 (Regulation of Property Maintenance). (Ord. 1634 § 27, 2024)
9.16.090 Penalties.
Violations of any provision of this Chapter shall be punishable as set forth in PMC Chapter 1.12 (Penalty Provisions). Each day that a violation of this Chapter occurs shall constitute a new and separate offense as provided in PMC § 1.12.030 (Continuing violations). (Ord. 1634 § 28, 2024)
