DISPLAYING PERSONAL PROPERTY FOR SALE – PARKING FOR REPAIR

OR MAINTENANCE

12.24.010 Definitions.

As used in this chapter:

(A) “Designated road” means the local street that runs adjacent and parallel to Avenue S, between 26th Street East and 30th Street East. The designated road shall be posted with signs with the following language, or language substantially similar: “Display of Vehicles for Sale Prohibited.”

(B) “Vehicle” means a vehicle as defined in Section 670 of the California Vehicle Code as the section reads as of the effective date of the ordinance codified in this chapter or may thereafter be amended.

(C) “Vessel” means a vessel as defined in Section 9840(a) of the California Vehicle Code as it reads as of the effective date of the ordinance codified in this chapter or may thereafter be amended. (Ord. 1417 § 1, 2011; Ord. 542 § 1, 1984)

12.24.020 Prohibited parking or display.

No person shall park a vehicle, vessel or other personal property:

(A) Upon a designated road for the purpose of displaying such vehicle, vessel or other personal property thereon for sale, hire or rental;

(B) Upon any roadway for the principal purpose of painting, greasing or repairing a vehicle or property thereon except repairs necessitated by emergency; or

(C) Upon any roadway for the principal purpose of washing or polishing such vehicle or vessel or any part thereof when a charge is made for such service. (Ord. 1614 § 4 (Exh. I), 2023; Ord. 1417 § 1, 2011; Ord. 542 § 2, 1984)

12.24.030 Violation – Removal authorized.

(A) Any person violating or failing to comply with any provision, regulation, or requirement of this chapter shall be deemed guilty of a violation pursuant to Chapter 1.12 PMC.

(B) Vehicles parked on a designated road for the purpose of displaying such vehicle for sale may be removed pursuant to California Vehicle Code Section 22651.9. (Ord. 1417 § 1, 2011; Ord. 542 § 3, 1984)

12.24.040 Exceptions – Parking or display on private residential property.

Notwithstanding anything herein to the contrary, this chapter shall not prohibit any person from parking, for the purpose of displaying for sale, up to two vehicles on (1) privately owned property if such property is zoned for residential use and such person resides on such property or (2) the public street immediately adjacent to such private property.
