Chapter 16.40
GENERAL PROVISIONS

16.40.030 Other permits required.
16.40.010 Title.
The ordinance codified in this chapter shall be known as the “grading ordinance of the City of Poway.” (Ord. 345, 1991)
16.40.020 Purpose.
The purpose of the grading ordinance is:
A. To establish an official set of standards regulating the design and construction of building sites and the development of property by grading;
B. To regulate the alteration of the ground surface to protect and preserve the public health, safety, and general welfare;
C. To regulate the clearing, brushing and grubbing, grading, excavating, stockpiling of earth, filling, earth moving and alteration of private and public lands to preserve environmentally significant features and to protect environmentally sensitive species and habitats including but not limited to archaeological or historical resources, open space areas with biological significance, and transition areas between land to be cleared for fire-fuel mitigation and permanent open space;
D. To minimize differential settlement, slipping or sliding of earth;
E. To protect adjacent properties from damage caused by blockage, diversion, or channeling of natural runoff waters;
F. To require engineering and geological analysis of soil conditions;
G. To provide erosion control and proper drainage;
H. To provide a basis for the design of footings, floor slabs and structures to be erected on parcels of land whose natural topography has been altered;
I. To establish an administrative procedure for issuance of permits;
J. To provide for approval of plans and inspection of grading construction; and
K. To provide for the enforcement of the requirements contained in this division. (Ord. 345, 1991)
16.40.030 Other permits required.
Nothing in this grading code shall preclude the inclusion in any use permit, subdivision approval, variance, waiver, review or other approval issued or approved pursuant to the City zoning ordinance or requirement concerning the grading of land. Nothing in this grading code shall preclude the requirement for the owner or applicant to obtain any other permit or approval required by law from any other public or private party, or agency.
