12.20.010 Findings and authorization.

(1) The City Council hereby finds that the preparation and adoption of certain specific street and highway plans, which are provided for by law, is necessary to implement elements of the general plan, to promote and protect the public health, safety, comfort, convenience and general welfare, to preserve light and air and to provide for future traffic requirements.

(2) The City Council hereby authorizes and directs the preparation of the following plans in written description and/or map form:

(a) Future width lines.

(b) Official plan lines.

(c) Setback lines.

(3) All such plans shall constitute specific plans, as provided for and authorized in the State planning and zoning law, shall be based on adopted elements of the general plan, and shall be prepared and adopted in accordance with procedures provided by law pertaining to specific plans. 12.20.020 Future width line plans.

(1) Future width line plans shall define or show the land areas required for future street widening in accordance with the general plan by lines precisely dimensioned from existing right-of-way lines, or from actual or established centerlines.

(2) Such plans shall be adopted as amendments to this chapter, and shall constitute subsections of subsection (3) of this section.

12.20.030 Official plan line plans.

(1) Official plan line plans shall define or show the land areas required for future streets or for street extensions or realignments in accordance with the general plan by precisely dimensioned land boundaries and ties to existing monuments, existing corners, or from actual or established street center lines.

(2) Such plans shall be adopted as amendments to this chapter, and shall constitute subsections of subsection (3) of this section.

(3) Official Plan Line Plans. (Reserved). [Ord. 61 § 3, 1968.]

12.20.040 Setback line plans.

(1) Setback line plans shall define or show the land areas between existing or adopted future road right-of-way lines and precisely dimensioned setback lines, such land areas being subject to the provisions of this chapter.

(2) Such plans shall be adopted as amendments to this chapter, and constitute parts of future width line plans or official plan line plans, or shall constitute subsections of subsection (3) of this section.

12.20.050 Construction prohibited – Exceptions.

It shall be unlawful for any person, firm or corporation to erect or construct any building or structure upon any land area included within any adopted future width lines, official plan lines or setback lines, with the exception of the following:

(1) Street improvements, driveways, sidewalks, fences, utility lines or structures, or similar structures or installations which have first been approved by the Department of Public Works.

(2) Temporary buildings or structures having a value as determined by the Director of Public Works of not more than $500.00, which may be permitted upon the securing of a conditional use permit from the Planning Commission in each particular case. [Ord. 61 § 5, 1968.]

12.20.060 Variances.

Variances in the provisions of this chapter may be approved in cases of unusual hardship which would result from the strict application of such regulations.

Upon receipt of a written request for variance, the Planning Commission shall, within 45 days, consider such request and recommendations of the Department of Public Works with respect thereto and submit a report thereon to the City Council.

The City Council shall act upon any such request within 30 days of receipt of the report thereon. [Ord. 61 § 6, 1968.]

12.20.070 Violation – Penalty.

Any violation of the provisions of this chapter shall constitute a misdemeanor, and shall be punishable as such.

Any building or structure erected or constructed in violation of the provisions of this chapter shall constitute a public nuisance, and may be caused to be removed by order of the City Council at the expense of the owner thereof. [Ord. 61 § 7, 1968.]
