5.36.010 Licensing authorized—Fee.
The licensing of billiard halls, poolrooms and places where billiard and pool tables are maintained for public use is permitted. The license fee for the same is fixed at four dollars ($4.00) per quarter. (Prior code § 5.52.010)
5.36.020 Poolroom defined.
For purposes of this chapter a “poolroom” is defined to include any regularly maintained place whereby pool, pinball, snooker and other similar games are offered for use by the public for hire in an enclosed or partially enclosed area. (Prior code § 5.52.020)
5.36.030 Hours of operation.
It is unlawful for the owner, proprietor, manager or other person having charge of any public billiard hall or poolroom to keep the same open or to allow any game or amusement to be played or carried on therein after the hour of two a.m. of any day or before the hour of six a.m. of any day, or to allow any person except the owner, proprietor, manager or other person in charge thereof or the servants regularly employed in or about the same to be in or remain therein after the hour of two a.m. and before the hour of six a.m. of each day. 5.36.040 Minors on premises.
Minors may be permitted in poolrooms providing they are supervised by a responsible adult person at all times or are accompanied by a parent or adult; and during the times minors are generally permitted, no consumption of alcoholic beverages in the poolroom is permitted. (Prior code § 5.52.040)
5.36.050 Serving of alcoholic beverages restricted.
Where poolrooms are operated in connection with or within one hundred (100) feet of any place dispensing alcoholic beverages for on-premises consumption and where alcoholic beverages may be permitted at times in the poolroom, the hours for use by minors and the fact that alcoholic beverages are prohibited during such hours shall be prominently posted and observed, and a permit for the operation of the poolroom in connection with or within one hundred (100) feet of such establishment must first be obtained from the chief of police. No opening between the place dispensing alcoholic beverages and the poolroom shall be maintained except by authority granted in the permit given by the chief of police, under such conditions as he or she shall impose. In issuing a permit, the police chief shall be guided by such factors as the type of alcoholic beverages sold and the comparative rate of sales by volume of nonalcoholic to alcoholic beverages sold on the premises, the past history of law enforcement problems in connection with the use of alcoholic beverages at the premises and the degree of access and controls to eliminate the possibility that alcoholic beverages might be consumed in the poolroom during the hours for use by minors and the degree of control maintained by the operator. In granting a special permit, the police chief shall also be guided by the greater benefits to be gained by affording greater observation and supervision as compared to the possible exposure of minors to persons under the influence of alcoholic beverages. 5.36.060 Compliance with other laws.
All establishments licensed under this chapter shall be at all times operated and maintained in such manner as may be otherwise prescribed by state and municipal laws, ordinances, rules and regulations, as well as subject to such fire and police supervision as is or as may be prescribed by the city.
