Article 1. Fire Department

5-3-100 Recognition of service of Volunteer Fire Department.

It shall be hereby recognized that the San Juan Bautista Volunteer Fire Department has been continuously serving the City of San Juan Bautista as its Volunteer Fire Department since 1868.

5-3-105 Establishment.

The City of San Juan Bautista Fire Department is hereby established pursuant to Section 38611 of the Government Code.

5-3-110 Volunteer members.

Members of the Fire Department shall consist of volunteer firefighters appointed by the Fire Chief, of sufficient number as the City Council may determine. Volunteer firefighters serve at the pleasure of the City Manager and have no right to continued service in such capacity. No firefighter’s service shall be discontinued without consultation with the Fire Chief.

Article 2. Fire Chief

5-3-200 Establishment.

The position of Fire Chief is hereby created and established pursuant to Section 38611 of the Government Code. The Fire Chief shall be appointed by the City Manager and shall serve at the pleasure of the City Manager and has no right to continued service in such capacity. Whenever feasible the Fire Chief may be appointed from the ranks of the volunteer firefighters.

5-3-205 Duties and responsibilities.

The Fire Chief shall have the following duties and responsibilities.

(A) Under the administrative direction of the City Manager is responsible for the overall management of the Fire Department, and for fire prevention, suppression and inspection within the incorporated boundaries of the City.

(B) Manages the appointment and training of volunteer firefighters in accordance with all applicable federal, state and city statutes, rules and regulations.

(C) Directs all activities necessary to provide fire protection to the City.

(D) Develops policies, rules and procedures for the operation of the Fire Department.

(E) Directs the care and maintenance of supplies, equipment and materials in a condition satisfactory for the carrying out of the day-to-day operations of the Fire Department.

(F) Maintains a current inventory of all supplies, equipment and materials of the Fire Department.

(G) Assists in the preparation of the annual budget for the Fire Department.

(H) Cooperates with the City Manager in establishing and maintaining sufficient and satisfactory procedures and controls over revenues (including donations from sources other than the City) and expenditures in the Fire Department.

(I) Is responsible for the immediate transfer of all funds received by the Fire Department or by members of the Department, from any source whatsoever to the City Manager or City Treasurer for deposit into appropriate Fire Department account(s) of the City. All funds in such account(s) raised through Fire Department fund raising efforts, except funds that may be owed by the Fire Department to the City, shall only be allocated for fire protection/suppression purposes.

(J) Prepares or causes to be prepared and presents to the City Manager and the City Council in sufficient detail to show the exact financial condition of the Fire Department, the following reports:

(1) A quarterly, or more frequently as requested, statement of all receipts, disbursements and balances of the Fire Department allocated funds (including donations from other sources).

(2) An annual statement of the financial condition of the Fire Department.

(3) A quarterly or more frequently as requested, statement of Fire Department activities including fire suppression, fire prevention, emergency medical aid, and inspections.

(4) Such other reports as the City Council or the City Manager may request.

(K) Performs such other additional duties and functions as may be directed by the City Manager.
