6-1-110 Providing of building.
Article 1. Public Libraries
6-1-100 Establishment.
A public library is hereby established in and for the City of San Juan Bautista, County of San Benito, State of California.
6-1-105 Management.
Said library shall be known as the “San Juan Public Library” and shall be under the management of a Board of Library Trustees, consisting of five (5) persons, to be appointed by the Mayor of San Juan Bautista, by and with the consent of the City Council; said Board of Library Trustees shall hold office for such time, and in such manner, and have such powers, as is or are provided for and prescribed by law and this Chapter; said library shall be opened, kept and maintained in any room, building or portion thereof, situated within the corporate limits of the City of San Juan Bautista, that is accessible to the public and otherwise suitable.
6-1-110 Providing of building.
The City Council of San Juan Bautista shall provide said room or building for said library, unless the said Board of Library Trustees secure and provide for the same, and the cost of procuring, renting, and maintaining such room or building and the maintaining of said library, shall, in all cases, be a City charge, and payable out of the Library Fund of said City.
6-1-115 Library Fund.
The City Council of San Juan Bautista, at the regular meeting thereof in January of each year, shall set off in a fund, to be known as the “Library Fund,” the amount deemed by said council to be necessary for the maintenance of said library during the fiscal year; provided, that after January, 1906, the money for said library so apportioned each year shall be the amount realized from the tax levied for said library purposes in and for that year.
6-1-120 Maintenance of Fund.
The Treasurer of the City of San Juan Bautista shall keep said money, so apportioned, together with all monies paid into the treasury of said City for the purposes and benefit of said library, in and to the credit of said Library Fund, and pay the same out only on warrants duly drawn and presented against said Library Fund, and warrants drawn against said Library Fund shall not be paid with money of any other fund.
6-1-125 Demands against Fund.
All demands against the said Library Fund shall be in like general form as other demands against the said City of San Juan Bautista, and shall specify that said demand is payable out of said Library Fund, and said demand shall be presented to the said Board of Library Trustees for allowance, and if allowed by said Board such allowance shall be certified to thereon by the President of said Library Board, and thereupon said demand shall be filed with the City Clerk, and when said demand shall have been so filed, with the proper certification thereon, the City Council shall order a warrant drawn, for the amount allowed in said demand, payable out of said Library Fund.
6-1-130 Receive property.
The said Board of Library Trustees are hereby authorized to receive, for and in behalf of the said City, any and all property that shall be received or acquired for the purposes, use or benefit of said library, and when not inconsistent with the terms of its acquisition, or unless otherwise designated, the title of all said property so received by said Board of Library Trustees shall vest in the City of San Juan Bautista.
