2.35.010 Organization generally – Director of Public Works.

The Department of Public Works Administration shall be under the immediate supervision of the Director of Public Works who shall be in the unclassified service and shall be hereinafter referred to as Director of Public Works. The Director of Public Works shall supervise and be responsible for all engineering work, including, but not limited to, the preparation of engineering maps, surveys and designs. He/she shall also have executive and administrative direction and direct supervision of the Building Maintenance Department and Engineering Department, all under the supervision of the City Manager. 2.35.020 Approval of plans, specifications and designs.

The City Engineer, who shall be in possession of a valid certificate of registration as a civil engineer by the California Board of Professional Engineers, is granted the discretionary authority to approve plans, specifications and designs for “public works,” as that term is defined in Labor Code Section 1720 and Section 1310 of the Charter. The City Engineer may delegate authority to approve plans, specifications and designs for public works projects, in writing, to a City of Santa Clara employee, so long as such employee possesses a valid certificate of registration as an engineer by the California Board of Professional Engineers both at the time of delegation and at the time of approval of the plans, specifications and designs.

The Director of Electric Utility and Assistant Director of Electric Utility, and each of them, are granted the discretionary authority to approve plans, specifications and designs for public works projects related to the City’s electric system so long as such Director or Assistant Director possesses a valid certificate of registration as an engineer by the California Board of Professional Engineers at the time of approval of the plans, specifications and designs.

The Director of Water and Sewer Utilities is granted the discretionary authority to approve plans, specifications and designs for public works projects related to the City’s water and sewer systems so long as such Director possesses a valid certificate of registration as an engineer by the California Board of Professional Engineers at the time of approval of the plans, specifications and designs.
