17.12.010 Permit required.
It is unlawful for anyone to tear or dig up any portion of a public street or sidewalk within the City without first obtaining a permit therefor from the City Engineer. [Ord. 408 § 1, 1948.]
17.12.020 Conditions of permit issuance.
The City Engineer shall not grant such permit unless he is satisfied that the person, firm, or corporation desiring such permit has a good and valid reason for doing so and unless such person, firm, or corporation first deposits with the City Clerk a reasonable amount to be fixed by the City Engineer, but not less than $50.00, as a guarantee that the portion of the street or sidewalk shall, after such person’s, firm’s or corporation’s work has been completed, be promptly restored to as good a condition as it was before it was torn or dug up. The deposit shall be returned to the person, firm, or corporation if the portion of the street or sidewalk is, after the completion of the work, promptly restored to as good a condition as it was before it was torn or dug up; otherwise, the deposit shall be forfeited to the City as damages. 17.12.030 Penalty for violation.
Any person, firm, or corporation violating any provision of this chapter shall be guilty of an infraction. [Ord. 1054 § 7, 1990; Ord. 408 § 3, 1948.]
