2.72.010 Created.
The Solana Beach public arts commission is hereby created as an advisory commission to the city council. General provisions of the commission are referenced in Chapter 2.60 SBMC, unless otherwise specified. (Ord. 453 § 2, 2014; Ord. 370 § 1, 2008; Ord. 327 § 1, 2004; Ord. 181 § 1, 1993)
2.72.020 Membership.
The public arts commission shall consist of seven members who shall serve at the pleasure of the city council. Members shall be appointed by the city council at large. The term of office shall be two years. Members may be appointed to successive terms. Additional terms may be added by resolution. 2.72.030 Duties.
The public arts commission shall have the power, and it shall be the duty of the commission, to make recommendations to the city council and to advise the council and city manager pertaining to the following matters:
A. Provide direction and support for the development and presentation of a variety of arts in the city;
B. Provide a forum for art concerns and recommendations to the elected officials and their staff concerning arts issues;
C. Develop cooperative arrangements between the city and other agencies, local, state, and federal, to provide needed arts facilities for the city;
D. Provide for the selection, installation and maintenance of works of art within public facilities;
E. Encourage private funding in all areas of the arts;
F. Promote cooperative arrangements between the city and other agencies, local, state, and federal, to provide works of fine art for display in public places;
G. Facilitate the utilization of free public exhibition spaces;
H. Review and make recommendations upon all works of art to be acquired by the city, either by purchase, gift or otherwise, and their proposed locations;
I. Review and make recommendations with reference to any existing works of art in the possession of the city in connection with the removal, relocation or alteration thereof;
J. Determine a method or methods of recommending the selection and commissioning of artists with respect to the design, execution and placement of works of art for which appropriations have been made, and pursuant to such method or methods, recommend to the city council a selection of artists by contract for such purposes, emphasizing but not limiting their recommendations to local artists living or working in the city of Solana Beach;
K. Prior to payment for works of art, review such works to report on the conformity of the finished work with the approved plans or other documents describing the work of art to be carried out;

2.72.040 Powers delegated to the public arts commission to be advisory.
Nothing in this chapter shall be construed as restricting or curtailing any of the powers of the city council, or as a delegation to the public arts commission of any of the authority or discretionary powers vested and imposed by law in the city council. The city council declares that the public interest, convenience and welfare require the appointment of a public arts commission to act in a purely advisory capacity to the city council for the purposes enumerated. Any power herein delegated to the commission to adopt rules and regulations shall not be construed as a delegation of legislative authority but purely a delegation of administrative authority. 2.72.050 Funds – Disposition of moneys.
A. Funds Generally. The public arts commission is authorized to and may solicit and receive, on behalf of the city, donations, gifts, legacies, endowments or bequests made to the city or to the commission for or on behalf of the city for the acquisition of art, subject to the approval of the city council.
B. Gifts Paid to Treasurer. All donations, gifts, legacies, endowments or bequests so received by the commission shall be turned over to the city treasurer, and shall be kept in a special fund to be designated as the public arts fund.
C. Public Arts Account. The city council shall establish an account in the general fund to be known as the “public arts account.” There shall be deposited to and expended from this account all gifts, legacies or bequests as set forth in subsection B of this section and including the proceeds derived by the commission on behalf of the city in connection with the promotion of public arts. All moneys in the account shall be used for public arts promotion and not otherwise, and if not used during any current year shall accumulate in the public arts account.
