2.76.010 Established.
The citizens general plan advisory committee of the city of Solana Beach is hereby created and established. (Ord. 247 § 1, 1998)
2.76.020 Composition – Appointment.
The citizens general plan advisory committee shall consist of 21 members. The city council shall by a general consensus confirm membership in the citizens general plan advisory committee. To the extent feasible, appointments shall be made in a manner which will assure equal representation by the various geographic sectors of the community. The director of community development, the city engineer, and the city attorney shall be ex officio members of the citizens general plan advisory committee. Ex officio members may participate in the meetings of the citizens general plan advisory committee, but no ex officio member shall be entitled to a vote. Each regular member of the citizens general plan advisory committee shall be appointed to a term of six months. If necessary, the council may extend the terms of the members to complete the committee’s duties. (Ord. 247 § 2, 1998)
2.76.030 Absence from meetings.
If a regular member of the citizens general plan advisory committee is absent from two successive regular meetings of the committee without cause, the community development director shall inform the mayor of such absence who may then remove the member from the committee without further notice. A vacancy is created by the removal of a regular member pursuant to this section, or by the written resignation from a member of the committee addressed to the mayor and city council. The vacancy shall be filled in the same manner as for the original appointment of the member who was replaced. (Ord. 247 § 3, 1998)
2.76.040 Regular and adjourned meetings.
Regular meetings of the citizens general plan advisory committee shall be held twice each month. Any meeting held pursuant to this section, or any special meeting advertised as a public hearing shall be deemed a regular meeting. Regular meetings shall be held in a public ADA accessible building such as Solana Beach City Hall at 635 S. Highway 101 unless otherwise approved by the Solana Beach city council. The citizens general plan advisory committee may adjourn any regular meeting from time to time to meet at a time and public place specified at the regular meeting. (Ord. 247 § 4, 1998)
2.76.050 Officers – Rules – Records.
The citizens general plan advisory committee shall elect from its appointed members a chairperson, vice chairperson and recording secretary to serve for a term of six months. The committee may adopt rules for the transaction of business that shall be substantially similar to the provisions of city ordinances regulating the conduct of city council meetings. All meetings of the citizens general plan advisory committee shall be subject to the State Open Meeting Law applicable to the conduct of meetings by legislative bodies of a city (Ralph M. Brown Act). The citizens general plan advisory committee shall not hold a closed meeting unless previously authorized in writing by the city attorney. The citizens general plan advisory committee shall keep minutes of its meetings and a record of the resolutions, transactions, findings and determinations of the committee. The minutes and record shall be a public record and shall be filed with the office of the city clerk. (Ord. 247 § 5, 1998)
2.76.060 Quorum and vote.
Fifty percent plus one member of the citizens general plan advisory committee shall constitute a quorum for the transaction of business. The affirmative vote of at least 50 percent plus one member of the committee shall be required for any committee action relating to a recommendation to the city council. Tie votes, or votes failing to obtain the affirmative vote of 50 percent plus one member of the committee shall constitute no action and the matter voted upon shall remain before the committee and shall be subject to further committee consideration. If the committee is unable to take action on a matter before it because of a tie vote or the failure to receive 50 percent plus one affirmative vote, the matter shall again be considered at the next regular committee meeting. If the matter receives a tie vote or fails to receive 50 percent plus one affirmative vote at the subsequent meeting, the community development director shall inform the mayor of said situation who may then scheduled such topic for a subsequent council discussion. Every committee member should vote on a matter unless the member is disqualified by reason of a conflict of interest. A member who abstains from voting acknowledges that a matter may be decided by the members voting upon the question. (Ord. 247 § 6, 1998)
2.76.070 Duties.
A. It shall be the duty of the citizens general plan advisory committee to review city council specified city of Solana Beach general plan components in an advertised public meeting format and to subsequently make a written report with recommendations to the city council. The citizens general plan advisory committee will review the following specific components:
1. Traffic/Circulation Element. Includes Interstate 5/Lomas Santa Fe interchange, traffic issues on Lomas Santa Fe Drive from Interstate 5 to Highway 101, traffic issues on Stevens Avenue, acceptable levels of service (LOS), road-width standards.
2. Beach and Bluff Issues. Utilizing existing Coastal Bluff Landscape Guidelines, Chapter 17.62 SBMC, Shoreline and Coastal Bluff Protection, and portions of the general plan discouraging seawalls, make recommendations to the city council combining fine-tuning/altering these three areas into one new document, a coastal bluff general plan element. Beach sand replenishment issues shall also be included.
3. Housing Element. To be reviewed and commented on by the citizens general plan advisory committee after technical work is completed by a professional housing element consultant.
B. The committee shall use all reasonable efforts to complete the task within six months of the first meeting of the committee. Notice of public meetings shall be posted at City Hall and published in a local newspaper. A report and recommendation of the citizens general plan advisory committee shall be presented to the city council in the form of a resolution setting forth the recommendation of the committee and the vote of the members of the committee on the report and recommendation. The citizens general plan advisory committee shall have no authority to direct city staff to undertake particular tasks or actions. (Ord. 247 § 7, 1998)
2.76.080 Community development director duties.
The community development director or his designee shall provide support to the citizens general plan advisory committee in the following manner.
A. Advertise public meetings as scheduled by the citizens general plan advisory committee;
B. Prepare, post and distribute citizens general plan advisory committee agendas; and
C. Administer the contract for the professional planning consultant retained to:
1. Attend all citizens general plan advisory committee meetings,
2. Perform research and present information to the citizens general plan advisory committee based on the collective direction of the citizens general plan advisory committee, not to exceed the approved contract amount, and
3. Attend subsequent city council meetings as specified in the contract. (Ord. 247 § 8, 1998)
2.76.090 City council duties.
The city council of the city of Solana Beach shall:
A. Direct the city clerk to solicit citizen interest forms in order to appoint citizens general plan advisory committee members;
B. Authorize the community development director to solicit bids from qualified professional consultants based on the duties specified in this chapter; and
C. Upon completion of the six-month citizens general plan advisory committee term, hold a public meeting to receive and discuss the citizens general plan advisory committee recommendations. (Ord. 247 § 9, 1998)
2.76.100 Conflicts of interest.
The citizens general plan advisory committee shall report income, investments and interests in real property pursuant to the provisions of the state law and Solana Beach local conflict of interest code. The reporting categories made applicable to the community development director by the Solana Beach local conflict of interest code shall apply to the members of the citizens general plan advisory committee. Economic interest disclosure forms for the members of the citizens general plan advisory committee shall be made available by and filed with the city clerk and shall be public records.
