4.42.010 Taxicabs and taxicab operators.
Subject to the provisions of Chapters 4.02 and 4.04 SBMC, the provisions of Title 2, Division 1 of the County Code of Regulatory Ordinances, commencing with Section 21.301, relating to taxicabs and taxicab operators, as amended to October 26, 2007, are adopted by reference. Amendments to references to the San Diego County Code are as follows:
A. Section 21.301(a) reference is amended to read:
“Medallion” means the unique, pre-numbered decal placed on a taxicab left rear window by the Issuing Officer or designee annually, signifying that the “taxicab operator” is authorized to operate the vehicle as a taxicab in the City of Solana Beach.
B. Section 21.301(e) reference is amended to read:
“Taxicab driver’s identification card or Driver’s Identification Card” means the annual license issued by the Issuing Officer of the County of San Diego to a taxicab driver under this chapter authorizing the driver to operate a taxicab in the County of San Diego.
C. Section 21.301(g) reference is amended to read:
“Taxicab operator’s license” means the annual license issued by the Issuing Officer for the City of Solana Beach authorizing a taxicab operator to pick up passengers in the City of Solana Beach.
D. Section 21.304 reference is amended to add:
(c) It is unlawful to operate a taxicab business in the City of Solana Beach without a valid Business Certificate pursuant to Chapter 4.02 of the Solana Beach Municipal Code.
E. Section 21.305(c) reference is amended to read:
If the Issuing Officer is satisfied that a taxicab has passed an inspection required by this section, the Issuing Officer shall issue an annual taxicab permit and he or his designee shall affix a medallion on the vehicle rear window thereby authorizing the operator to place the taxicab in service for one year or until the expiration of the medallion.
F. Section 21.305(d) reference is amended to read:
It shall be unlawful for any person other than the Issuing Officer or his designee to place a medallion on or remove a medallion from a taxicab. It is unlawful to tamper with or alter a medallion. As designees, law enforcement officers are authorized to remove expired medallions or medallions found on vehicles for which the medallions were not issued.
G. Section 21.305(e) reference is amended to read:
It is unlawful to operate a taxicab in the City of Solana Beach without a valid medallion.
H. Section 21.306(b) reference is amended to add:
(16) No window tint shall be applied to any window of a taxicab.
I. Section 21.307(a) reference is amended to read:
It is unlawful for any taxicab driver to pickup or discharge passengers in the City of Solana Beach without first obtaining a taxicab driver’s identification card as issued by the Issuing Officer for County of San Diego. The Issuing Officer for the County of San Diego may issue an applicant a temporary identification card for up to 60 days, while an investigation is pending.
J. Section 21.308 reference is amended to add:
(e) It is unlawful to drive a taxicab in the City of Solana Beach with an expired Driver’s Identification Card.
K. Section 21.308 reference is amended to add:
(f) It is unlawful to drive a taxicab in the City of Solana Beach without a Driver’s Identification Card.
L. Section 21.311(a) reference is amended to read:
It is unlawful for any person to operate a taxicab business within the City of Solana Beach unless the person has a valid insurance coverage issued by a company authorized to transact insurance business in the State of California with coverage amounts that meet the minimum requirements pursuant to Section 21.311(b). A taxicab operator shall furnish the Issuing Officer and the City with a Certificate of Insurance coverage and a separate endorsement of the City of Solana Beach as additional insured. This is a prerequisite to obtaining a taxicab operator’s license. The certificate shall provide that the insurer will notify the Issuing Officer in writing of any policy status change, including cancellation and any cancellation notice shall be sent to the Issuing Officer by registered mail at least 30 days prior to cancellation of the policy. The certificate shall also state:
(1) The full name, address and phone number of the insurer;
(2) The full name, address and phone number of the insured as they appear on the taxicab operator permit and on the City taxicab permit application;
(3) The insurance policy number;
(4) The type and limits of coverage;
(5) The specific vehicle(s) insured;
(6) The effective dates of the certificate; and
(7) The certificate issuance date.
M. Section 21.311(b) reference is amended to read:
The insurance shall provide coverage for each taxicab in an amount not less than $1 million per occurrence, combined single limit for bodily injury and property damage.
N. Section 21.315 reference is amended to add:
(p) While a taxicab is available for hire, it is unlawful for a taxicab driver to stop, park, or otherwise stand at the curb or edge of any roadway within the City of Solana Beach except for designated taxicab stands. However, a taxicab may stop, park, or stand in any available parking space when the taxicab driver is actively engaged in loading or unloading passengers, or when hailed from the street or curb to accept a passenger for hire.

4.42.020 Enforcement.
Any violation of the provisions of this chapter shall constitute of violation of the Solana Beach Municipal Code, and is subject to the penalty provisions as set forth in Chapters 1.16 and 1.18 SBMC. (Ord. 422 § 2, 2010)
