CHAPTER 1. SEWER SERVICE
8-01-1000 DEFINITIONS:
For the purpose of this Chapter, the following words and phrases shall have the following meaning:
(a) "Board" or "Board of Supervisors" means the Board of Supervisors of the County of Tulare.
(b) "Building" means any structure, house, or unit inhabited or used by humans.
(c) "County" means the County of Tulare or the unincorporated territory within the County of Tulare.
(d) "El Rancho" means Zone of Benefit No. 1 of the County Service Area No. 1 as established within the County of Tulare pursuant to California Government Code section 25210.1 et seq., and more particularly section 25210.8, by Board of Supervisors’ Resolution No. 86-0312.
(e) "House" means a detached single family dwelling.
(f) "Owners of improved real property" has the meaning set forth in California Health and Safety Code section 4958 and includes persons who are recorded on the books of the County Clerk/Recorder/Assessor and County Tax Collector as the owners of lots or parcels of land that are improved by buildings.
(g) "Parcel" means the division of land described as a parcel on the County tax rolls for property tax purposes. However, if such division of land is further divided into legal lots of record, each such lot shall be a separate parcel within this definition.
(h) "Sewage Works" has the same meaning as "works" under California Health and Safety Code section 4950 and includes sewage treatment plants, intercepting and collecting sewers, outfall sewers, force mains, pumping stations, ejector stations, and all other appurtenances necessary, useful, or convenient, for the collection, treatment, purification, or disposal of sewage, and necessary lands, rights of way, or other property.
(i) "Unit" means a mobile home or a unit of a duplex, apartment building, or any other multi family dwelling or complex.
8-01-1005 PROHIBITION:
Because El Rancho is or shall be provided with sewage works, the Board hereby declares, pursuant to the authority of California Health and Safety Code section 5009, that the further maintenance or use of cesspools, septic tanks or other local means of sewage disposal within El Rancho and within one hundred (100) feet of the El Rancho sewer works is a public nuisance and is hereby prohibited in El Rancho. Such prohibition shall be effective ninety (90) days from the effective date of this Ordinance.
8-01-1010 COMPULSORY CONNECTION WITH SEWAGE SYSTEM:
Under the authority of California Health and Safety Code section 5009, all buildings, houses, and units within El Rancho and within one hundred (100) feet of the El Rancho sewage works shall be connected with the El Rancho sewer sewage works within ninety (90) days of the effective date of this Ordinance Code.
8-01-1015 VIOLATIONS:
Every owner of improved real property violating any of the provisions of this chapter shall be guilty of an infraction for each day of violation and shall be punishable as provided in section 125 of this Ordinance Code.
