§2330 PARADE VENDORS; OPERATION WITHOUT LICENSE UNLAWFUL

It shall be unlawful for any person to engage in the business of vending, hawking or in any way merchandising items during parades held in the City without first securing a license from the City. (Ord. 709, §1, adopted 1978)

§2331 APPLICATION FOR LICENSE, FEE, IN ADVANCE

Application for a business license shall be made in the office of the Director of Finance for the City. A fee of twenty five dollars ($25.00) per day of operation shall be paid by applicant. Applicant shall also provide their sales tax permit number to the City. Application shall be made at least two (2) weeks in advance of any scheduled parade date. (Ord. 709, §1, adopted 1978)

§2332 EXCLUSIONS, EXEMPTIONS

Those exclusions and exemptions contained in Article 5 of Chapter 1 shall apply to this Article. (Ord. 709, §1, adopted 1978)

§2333 IDENTIFICATION, DEPOSIT

Properly licensed vendors shall wear visibly displayed at all times, while vending, an identification tag which will be issued by the director of finance. Each vendor shall wear such identification. There shall be a deposit required for each tag issued which shall be refunded upon the return of the tag. The director of finance shall establish a deposit which is sufficient to cover the cost of replacing any unreturned tags. (Ord. 709, §1, adopted 1978)

§2334 RESTRICTIONS

Vendors shall be restricted in their operations as follows:

A.    Vendors shall operate only on and along the sidewalks of the parade route.

B.    Vendors shall cross streets only at intersections and such crossing shall at no time disrupt the flow of the parade.

C.    Carts used by vendors for transporting merchandise while vending shall not exceed three feet (3’) in length, two feet (2’) in width and three feet (3’) in height. Carts must be pushed or pulled by the vendor and may not be self-propelled.

D.    In those parades which are designated as "band review parades" vendors shall not cross the street in designated silent areas, judging areas or reviewing stand area.

E.    In those parades which are designated as "band review parades" vendors shall not sell noisemakers, horns, whistles, or other items which make distracting noises. (Ord. 709, §1, adopted 1978)

§2335 VIOLATION; PENALTIES

Violation of this article shall constitute an infraction and shall be punishable by a fine not to exceed two hundred dollars ($200.00) for each violation. (Ord. 709, §1, adopted 1978; amd. by Ord. 933, §1, adopted 1993)
