§3290 PROHIBITION OF STRUCTURES CREATING AIR NAVIGATION HAZARDS
A. No person, firm, association, partnership, corporation, public entity subject to the jurisdiction of the City or other organized group acting as unit shall erect, construct, maintain or cause to exist within the corporate limits of the City of Ukiah any object, including a mobile object, structure or naturally growing thing, such as a tree or shrub, that would constitute an obstruction to air navigation by exceeding the heights or surfaces established in Title 14 of the Code of Federal Regulations Section 77.23 as it now reads or may be amended hereafter or any successor regulation, unless the Administrator of the Federal Aviation Administration (FAA) has issued a written order determining that the object will not constitute a hazard to air navigation or the California Department of Transportation (Caltrans) has issued a permit allowing the construction, alteration or growth of the object.
B. The City of Ukiah shall not issue any permit, including a Use Permit or Building Permit, authorizing the construction, alteration, maintenance or repair of any object, structure or naturally growing thing prohibited by subsection A of this Section, unless a copy of the order or permit described in subsection A has been filed with the City official responsible for issuing said permit. §3291 PENALTIES FOR VIOLATION
Any person, firm, association or corporation who violates any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than three hundred dollars ($300.00), or by imprisonment in the County jail of the County of Mendocino for not more than ninety (90) days, or by both such fine and imprisonment. Each person, firm, association or corporation shall be deemed guilty of a separate offense for each day during any portion of which any violation of the provisions of this Chapter is committed, continued or permitted by such person, firm, association or corporation.
