§6000 CONSUMPTION OF INTOXICATING BEVERAGE

No person shall drink any beer, wine or other intoxicating beverage on any street, sidewalk, alley, highway or public parking lot. This Section shall not be deemed to make punishable any act or acts which are prohibited by any law of the State of California.

Definition: For the purposes of this ordinance, the term "public parking lot" shall include city-owned parking lots, parking lots provided in shopping centers and such other parking lots which may exist or be hereafter designed and constructed for use of the public. §6000(a) PERMIT

Notwithstanding the foregoing, a permit may be granted by the City Manager upon recommendation of the Chief of Police, allowing such activities for special events. The term of the permit shall be limited therein. (Ord. 808, §1, adopted 1983 as an emergency measure)

§6000(b) OUTDOOR DINING

The service and consumption of alcoholic beverages, including, but not limited to, beer and wine at an outdoor dining location conducted in accordance with an outdoor dining program approved by the City Council, an outdoor dining location conducted in compliance with Section 9224.7 or a sidewalk cafe conducted in accordance with Section 9224.8 are exempt from and do not violate Section 6000. §6001 INTOXICATION IN PUBLIC PROHIBITED

It shall be unlawful for any person to be in a drunken or intoxicated condition or under the influence of intoxicating liquor or narcotic drugs within the corporate City limits of the City:

A.    While in or upon any street, thoroughfare, alley, sidewalk, public grounds, public places, places accessible to the public or place open or exposed to the public view;

B.    In, on, or about any automobile, motorcycle, motor vehicle, street car, railroad car or other vehicle. (Ord. 423, §2, adopted 1949; amd. by Ord. 742, §2, adopted 1980)

§6002 PENALTY FOR VIOLATION

Any violation of this Article shall be deemed a misdemeanor, punishable by a fine not to exceed three hundred dollars ($300.00) or by imprisonment not exceeding ninety (90) days, or by both such fine or imprisonment. (Ord. 742, §3, adopted 1980)
