§6310 POLICE TO STORE UNCLAIMED PROPERTY;1 RESTORATION TO OWNER
Except as otherwise provided by the laws of the State of California or of the United States of America or the provisions of this Article, all unclaimed personal property in the possession of the Police Department shall be stored in a safe place by the Chief of Police for at least six (6) months; provided, however, that the Chief of Police shall restore such property to its legal owner immediately upon proof of such ownership satisfactory to him and upon the payment of all reasonable necessary costs in the care and protection thereof, unless such property is held by the police as evidence, in which case it shall be disposed of only upon order of the proper court or officer. §6311 NOTICE OF INTENT TO SELL PROPERTY AT AUCTION
At any time after the expiration of said six (6) months period, the Chief of Police may publish once in a newspaper of general circulation in the City, a notice of his intention to sell at public auction to the highest bidder at the time and place therein specified, all such unclaimed personal property. §6312 TIME FOR SALE
The sale shall be held not less than fifteen (15) days after the publication of said notice. All items shall be sold at public auction to the highest bidders therefor. (Ord. 467, §3, adopted 1953)
§6313 EXPENSES OF SALE; DISPOSITION OF RECEIPTS
The expenses in connection with such sale shall be a proper charge against the funds of the Police Department and all proceeds received from said sale shall be delivered to the City Treasurer. (Ord. 467, §4, adopted 1953)
§6314 DISPOSITION OF PROPERTY UNSOLD AT AUCTION
The Chief of Police shall report any item remaining unsold after said public auction to the City Manager, who shall instruct said Chief what disposition shall be made thereof as he may see fit in the public interest. (Ord. 467, §5, adopted 1953)
§6315 PROPERTY SUBJECT TO CONFISCATION UNDER STATE OR FEDERAL LAW EXCEPTED
The provisions of this Article shall not apply to property subject to confiscation under the laws of the State of California or the United States of America. (Ord. 467, §6, adopted 1953)
§6316 DISPOSITION OF PERISHABLE GOODS; DANGEROUS PROPERTY
Any perishable goods or property which is dangerous in itself, or property which shall be contrary to public policy for the Police Department to retain, shall be disposed of in such manner as the Chief of Police may, in the public interest, determine. (Ord. 467, §7, adopted 1953)
§6317 DISPOSITION OF PROPERTY CONSISTING OF MONEY
If such unclaimed personal property shall consist of money, it shall be deposited with the City Treasury to be disposed of in the manner specified by law. (Ord. 467, §8, adopted 1953)
