3.24.010 Purpose – Authority.

A. The city council declares that the license taxes hereinafter referred to as “community facility fee” to be paid under this chapter are assessed pursuant to Section 37101 of the Government Code of the state of California and the taxing power of the city and solely for the purpose of producing revenue. The continued development of dwelling units and commercial facilities in the city and the increased use of and need for public facilities has created a need for additional revenues to meet these needs. Major new facilities and expanded facilities will be necessary including public buildings (such as fire stations, police facilities, maintenance facilities and general offices) as well as bridges, traffic signalization and major roads (over forty feet curb to curb) to serve the increase in population and commercial establishments.

B. From time to time as may be necessary, the city council may amend such rates and charges by resolution. (Ord. 1256 §1, 1985: Ord. 1110 §1, 1981).

3.24.020 Definitions.

For the purpose of this chapter the following words and phrases shall be as follows:

A. “Commercial facility” means any structure, premises or facility which is not a single or multiple family residence or any structure used for manufacturing, processing or industrial purposes.

B. “Single-family residence” means any detached structure designed for occupation by one family. “Single-family residence” includes mobile home pads (spaces) designed for temporary, permanent or semipermanent use. (Ord. 1110 §2, 1981).

3.24.030 Schedule of taxes.

The following license fee schedule shall be used for any new single-family residence, multiple residence or commercial facility for which a building permit is issued:

A. Single-family residence, seven hundred twenty dollars for each single-family residence of which the sum of one hundred dollars must be used by the city for future traffic signalization purposes;

B. Multiple-family residence, five hundred ten dollars for each unit of which the sum of seventy-five dollars must be used by the city for future traffic signalization purposes;

C. Commercial facilities, for each square foot contained in a commercial facility:

1. Fifty-eight cents per square foot for the first fifteen thousand square feet of which the sum of fifteen cents per square foot must be used by the city for future traffic signalization purposes;

2. Forty-five cents per square foot for the next fifteen thousand square feet of which the sum of twelve cents per square foot must be used by the city for future traffic signalization purposes;

3. Thirty-six cents per square foot for all square footage over the first thirty thousand square feet of which the sum of ten cents per square foot must be used by the city for future traffic signalization purposes;

4. Square footage shall be determined by adding the number of square feet of space on each floor or level. (Ord. 1110 §3, 1981).

3.24.040 Time and Place of payment.

The license taxes and fees shall be due and payable at the office of the building inspector, City Hall, Vacaville, California, 95688, prior to the issuance of a building permit. (Ord. 1110 §4, 1981).

3.24.050 Use of proceeds.

All of the moneys collected under this chapter shall be used solely for public facilities, major streets and bridges. (Ord. 1110 §5, 1981).

3.24.060 Dwelling unit charge increase.

On November 1, 1981, and each November 1 thereafter, the dwelling unit charge shall increase to equal increases in construction costs as set forth by Engineering News Record Index. The twelvemonth average for the previous year shall determine the percentage of increase. (Ord. 1110 §7, 1981).
