SPECIAL PURPOSE DISCHARGE PERMIT

3.60.010 Special purpose discharge permit application.
Special purpose discharge permits shall be expressly subject to all provisions of this chapter and all other regulations, charges for use, and fees established by WCW. The conditions of special purpose discharge permits will be enforced by WCW in accordance with this chapter and applicable state and federal regulations, sludge management criteria, or the reuse potential of the water by WCW.
A. Users seeking a special purpose discharge permit shall complete and file with WCW, prior to commencing discharge, an application in the form prescribed by WCW. This application shall be accompanied by any applicable fees, plumbing plans, a detailed analysis of the alternatives for water disposal, or other data as needed by WCW for review.
B. After evaluation of the data furnished, WCW may issue a special purpose discharge permit when no alternative method of disposal is reasonably available, or to mitigate an environmental risk or health hazard.
C. The permit application may be denied when the applicant has failed to establish to WCW’s satisfaction that adequate pretreatment equipment is included within the applicant’s plans to ensure that the discharge limits will be met or that the applicant has, in the past, demonstrated an inability to comply with applicable discharge limits. 3.60.020 Conditions and limitations.
A. Monitoring requirements for the discharge shall be for those noncompatible pollutants known to exist in the discharge. At least one analysis prior to sewer discharge shall be performed for all constituents contained in the most current Environmental Protection Agency (EPA) “Priority Pollutant” list.
B. WCW may specify and make part of each special purpose discharge permit specific pretreatment requirements or other terms and conditions determined by the WCW general manager to be appropriate to protect WCW facilities, to comply with regulatory agencies’ requirements to ensure compliance with this chapter, and to assess user charges. 3.60.030 Permit fee.
The special purpose discharge permit fee shall be paid by the applicant in an amount adopted by resolution of the WCW board. Payment of permit fees must be received by WCW prior to issuance of either a new permit or a renewed permit. Each permittee shall also pay delinquent invoices in full prior to permit renewal. 3.60.040 Permit modification of terms and conditions.
A. The terms and conditions of an issued permit may be subject to modification and change in the sole determination by WCW during the life of the permit based on:
1. The user’s current or anticipated operating data;
2. WCW’s current or anticipated operating data;
3. Changes in the requirements of regulatory agencies;
4. A determination by the WCW general manager that such modification is appropriate to further the objectives of this chapter.
B. A permittee may request a modification to the terms and conditions of an issued permit. The request shall be in writing stating the requested change, and the reasons for the change. WCW will review the request, make a determination on the request, and respond in writing.
C. A permittee will be informed of any changes in the permit at least 45 days prior to the effective date of change. Any changes or new conditions in the permit shall include a reasonable time schedule for compliance. [Ord. 2023-003 § 12.040]
3.60.050 Permit duration.
Special purpose discharge permits will be issued for a period not to exceed one year, but may be renewed as determined by the WCW general manager. Users seeking permit renewal shall comply with all provisions of this chapter. [Ord. 2023-003 § 12.050]
3.60.060 Discharge fees.
A charge for use to cover all costs of WCW for providing sewerage service and monitoring will be established by the WCW general manager. A deposit determined by the WCW general manager to be sufficient to pay the estimated charges for use shall accompany the special purpose discharge permit application, and said deposit shall be applied to the charges for use.
