10-1.01 Purpose.

The purpose of this chapter is to establish rules and regulations for use and conduct in the Pinto Lake Recreation Area as defined and delineated on the “Pinto Lake Area Map” on file in the office of the City Clerk.

10-1.02 Definitions.

For the purposes of this chapter, unless otherwise apparent from the context, certain words and phrases used in this chapter are defined as follows:

(a)    “City” shall mean the City of Watsonville and its agents and employees.

(b)    “Pinto Lake Recreation Area”, for convenience referred to in this chapter as “Pinto Lake”, “the Lake”, “the Park”, or “the Area”, shall include the waters of Pinto Lake within the boundaries of the City property, as well as the lands owned by the City contiguous to the Lake and devoted to recreational uses and facilities, including, but not limited to, boating, fishing, and other water activities.

(c)    “Vehicle” shall mean any device in or upon which persons or property may be transported on or over the land.

(d)    “Boat” shall mean any vessel or device in or upon which persons or property may be transported upon, over, or under the surface of the water.

(e)    “Camping” shall mean to establish or maintain outdoors or in, on, or under any structure at any time during the day or night a temporary or permanent place for cooking or sleeping by setting up any bedding, sleeping bag, blanket, mattress, tent, hammock, or other sleeping equipment or by setting up any cooking equipment with the intent to remain in that location overnight.

10-1.03 Adoption of rules and regulations.

Additional rules and regulations for the use of the facilities at Pinto Lake may be established by adoption of resolutions therefor by the Council.

10-1.04 Fees for permits or use.

Each visitor, patron, or other person using or desiring to use the facilities of Pinto Lake shall first pay such fees and charges as may be from time to time fixed by resolution of the Council.

10-1.05 Acts prohibited.

It shall be unlawful for any person to:

(a)    Park and/or leave unattended any boat or vehicle in areas other than those designated for parking. Vehicles or boats left unattended without the written permission of the City or in areas not designated for parking may be towed away and stored by the City, and such removal and storage costs shall be charged to and paid by the owner prior to the release of such boats or vehicles;

(b)    Operate a motor vehicle at speeds in excess of those posted by the City or in, upon, or over any area not constructed, set aside for, or intended to be used for vehicular traffic;

(c)    Picnic or lunch in a place other than a place designated for such purpose. Attendants shall have the authority to regulate the activities in such areas when necessary to prevent congestion and to secure the maximum use for the comfort and convenience of all persons. Visitors shall comply with any direction given to achieve such end;

(d)    Leave a picnic area before the fire is completely extinguished and before all trash in the nature of boxes, papers, cans, bottles, garbage, and other refuse is placed in the disposal receptacles where provided. If no such trash receptacles are available, such refuse and trash shall be carried away from the park area by the picnicker to be properly disposed of elsewhere;

(e)    Pick flowers, foliage, berries, or fruits or cut, break, dig up, or in any way mutilate or injure any tree, shrub, plant, fern, grass, turf, fence, structure, or any other object;

(f)    Cut, carve, paint, mark, paste, or fasten on any tree, fence, wall, building, monument, or other object any poster, bill, advertisement, or inscription;

(g)    Dig up or remove any dirt, stone, rock, or other substance whatever, make any excavation, quarry any stone, or lay or set off any blast or explosion, or cause or assist in doing any of such things;

(h)    Hunt, molest, harm, frighten, kill, trap, chase, tease, shoot, or throw missiles at any animal, reptile, or bird; nor shall any person remove or have in his possession the young of any wild animal or an egg, nest, or young of any bird;

(i)    Give, or offer or attempt to give, to any animal or bird any known noxious or toxic substance;

(j)    Despoil the premises or place or leave thereon any broken glass, wastepaper, can, bottle, or other rubbish, refuse, garbage, or polluted matter, except in receptacles provided for that purpose by the City;

(k)    Possess, discharge, or set off over, into, or through the Pinto Lake Recreation Area any firearm, BB gun, pellet gun; bow or arrow, firecracker, torpedo, rocket, or other explosive or firework;

(l)    Leave or abandon any animal, reptile, or bird at the Park;

(m)    Ride, drive, or permit or allow any horse, cow, dog, cat, or other domestic animal within the Pinto Lake Recreation Area without the permission of the City. In any event, such animals, if permitted by the City, shall be on a leash, properly harnessed, or otherwise adequately controlled;

(n)    Engage in soliciting, selling, or peddling any goods or services or distribute any commercial advertising circular;

(o)    Take fish at those locations or within an area specified in rules and regulations adopted by resolution of the Council provided such prohibited fishing areas are posted so as to provide reasonable notice of such prohibition and regulations; or

(p)    Fail to cooperate in maintaining rest rooms and washrooms in a neat and sanitary condition. No person over the age of five (5) years shall use the rest rooms and washrooms designated for the opposite sex.

10-1.06 Parking.

It shall be unlawful for any person to park a vehicle in other than an established or designated parking area, and such use shall be in accordance with the posted directions thereat and with the instructions of any attendant who may be present.

10-1.07 Bathing and swimming.

It shall be unlawful for any person to swim, bathe, or wade in any water or waterway in or adjacent to the Park, except in such waters and at such places as are provided and posted therefor and in compliance with such regulations as are posted thereat.

10-1.08 Games.

It shall be unlawful for any person to take part in or play any game involving thrown or otherwise propelled objects, such as balls, stones, arrows, javelins, or model airplanes, except in areas set apart for such forms of recreation. The playing of rough or potentially dangerous games with others, such as football, baseball, and soccer, shall be prohibited, except on the fields and courts or areas provided therefor.

10-1.09 Liquor.

It shall be unlawful for any person in the Pinto Lake Recreation Area:

(a)    To drink or consume alcoholic beverages at any time; or

(b)    To be under the influence of intoxicating liquor.

10-1.10 Camping permits.

All permits for overnight parking and camping shall be issued only to the registered owner or such other person in charge of each camper, trailer, trailer house, or other vehicle equipped for camping and sleeping. No permit shall be issued for any passenger vehicle, truck, or pickup, unless adequately equipped for camping.

10-1.11 Curfew.

It shall be unlawful for any person to be or remain in the Park at any time established by resolution of the Council as designated nighttime hours during which the Park is closed to the public, except for those persons to whom permits are issued for overnight camping. The opening and closing hours shall be posted at each entrance and exit thereof for public information.

10-1.12 Entertainment: Amplified sound.

It shall be unlawful to have live entertainment or sound application, with the exception of scheduled Little League games within the baseball diamond. Radios, record players, television sets, and tape players may be used only when the volume does not exceed the volume of normal conversational speech.

10-1.13 Boating speed limits.

It shall be unlawful for any boat, whether propelled by motor, sail, or any other force, to be operated upon Pinto Lake by any person at a speed greater than five (5) miles per hour.

10-1.14 Violations: Penalties.

Violations of the provisions of this chapter, or any rule or regulation adopted by the Council, or failure to pay any fee or charge as prescribed by the Council shall be prosecuted pursuant to the provisions of Chapter 2 of Title 1 of this Code.
