17.123.010 Purpose and intent.
It is the purpose and intent of this chapter to regulate the development and operation of farmworker housing land uses and allow for farmworker housing by right. (Ord. 2012-08 § 6 (part))
17.123.020 Definitions.
“Farmworker” means the same as “agricultural employee” as defined in Section 1140.4(b) of the California Labor Code.
“Farmworker dwelling unit” means a single-family residential unit occupied by a maximum of six farmworkers at any one time.
“Farmworker housing” means a housing accommodation developed for and/or provided to farmworkers and shall consist of any living quarters, dwelling, boarding house, tent, barracks, bunkhouse, maintenance-of-way car, mobile home, manufactured home, recreational vehicle, travel trailer, or other housing accommodation maintained in one or more buildings and on one or more sites. Farmworker housing shall consist of either a farmworker dwelling unit or a farmworker housing complex.
“Farmworker housing complex” means farmworker housing other than a farmworker dwelling unit that (1) contains a maximum of thirty-six (36) beds if the housing consists of any group living quarters, such as barracks or a bunkhouse, and is occupied exclusively by farmworkers; or (2) contains a maximum of twelve (12) residential units occupied exclusively by farmworkers and their households, if the housing does not consist of any group living quarters. 17.123.030 Standards.
A. Farmworker dwelling units by right are permitted in zones A-1, R-1, R-2, R-3, R-4 and D-B (secondary streets only).
B. Farmworker housing complexes by right are permitted in zones A-1, R-3 and R-4.
C. For single farmworkers, SRO housing will be permitted in C-2 zones.
D. These zoning changes will provide for by-right development of farmworker housing without the requirement for a CUP.
E. Farmworker housing shall comply with all applicable state laws including, when applicable, the California Mobilehome Parks Act.
F. To encourage and facilitate the development of farmworker housing, the city may allow flexible application of development standards. (Ord. 2012-08 § 6 (part))
