OFFENSES RELATING TO PUBLIC PEACE AND ORDER

9.12.010 Obstructing highway or other passageway.

A.    It is unlawful for any person to obstruct a highway or other passageway, as provided in this section. For purposes of this section, a person commits an offense if without legal privilege he intentionally, knowingly, or recklessly:

1.    Obstructs a highway, street, sidewalk, railway, waterway, building entrance, elevator, aisle, stairway, or hallway to which the public or a substantial group of the public has access; or any other place used for the passage of persons, vehicles, or conveyances, whether the obstruction arises from his acts alone or from his acts and the acts of others; or

2.    Disobeys a reasonable request or order to move issued by a person he knows to be a peace officer, a fireman, or a person with authority to control the use of the premises, to prevent obstruction of a highway or passageway, or to maintain public safety by dispersing those gathered in dangerous proximity to a fire, riot or other hazard.

B.    For purposes of this section, “obstruct” means to render impassable or to render passage unreasonably inconvenient or hazardous. (Prior code § 10-12)

9.12.020 Disorderly conduct.

A.    It is unlawful for any person to commit the offense of disorderly conduct as provided in this section. For purpose of this section, a person commits disorderly conduct if he intentionally, knowingly, or recklessly:

1.    Uses abusive, indecent, profane, or vulgar language in a public place, and the language, by its very utterance, tends to incite an immediate breach of the peace;

2.    Makes an offensive gesture or display in a public place, and the gesture or display tends to incite an immediate breach of the peace;

3.    Makes unreasonable noise in a public place, or near a private residence that he has no right to occupy;

4.    Fights with another in a public place;

5.    Not being a peace officer, discharges a firearm in a public place other than a shooting gallery or rifle range;

6.    Not being a peace officer, displays a deadly weapon in a public place in a manner calculated to alarm.

B.    It is an affirmative defense to prosecution under subsection (A)(2) of this section that the actor had significant provocation for his abusive or threatening conduct. (Prior code § 10-17)

9.12.030 Ethnic intimidation.

It is unlawful for any person to commit the offense of ethnic intimidation. For purpose of this section, a person commits ethnic intimidation if he, because of another person’s race, color, religion, ancestry or national origin:

A.    Knowingly, by words or conduct, places that person in fear of imminent lawless action directed at that person or that person’s property and such words or conduct are likely to produce bodily injury to that person or to that person’s property; or

B.    Knowingly causes damage to or destruction of the property of another person; or

C.    Publishes, distributes or posts in a public place any circular, pamphlet, card or other printed material, with intent to intimidate or harass another person. (Ord. 1991-8 § l: prior code § 10-21)
