WASTEWATER ENTERPRISE

13.02.040 Inconsistency with state statutes.
13.02.010 Governing body.
The City Council shall serve as the governing body of the wastewater enterprise, and the officers of the City Council and of the city shall serve as officers of the governing body and the wastewater enterprise. (Ord. 2005-9 § 1 (part))
13.02.020 Powers.
The wastewater enterprise shall have and may exercise the following powers: to hold meetings concurrently with regular or special meetings of the City Council, to adopt ordinances in the manner in which city ordinances may be adopted, to issue revenue bonds in the manner in which city revenue bonds may be issued without voter approval in advance, to pledge any revenues of the city’s wastewater system (the “wastewater system”) to the payment of such revenue bonds and to pay such revenue bonds therefrom, to enter into contracts, to enter into contracts relating to the wastewater system in the manner in which city contracts may be entered into, to make representations, warranties and covenants on behalf of the wastewater enterprise and to bind the wastewater enterprise to perform any obligation relating to the wastewater system. 13.02.030 Duties—Functions.
The wastewater enterprise shall continue to own the assets of the wastewater system, acquire and convey properties constituting part of the wastewater system, manage, operate and maintain the wastewater system, employees of the wastewater system, keep books and records relating to the wastewater system, invest and manage funds, budget and appropriate revenues and expenditures of the wastewater system, award and execute contracts and make expenditures relating to the wastewater system, fix, adjust and collect wastewater rates, fees, tolls and charges and tap fees, and prescribe rules and regulations relating to the wastewater system. The enterprise may also borrow money, issue bonds or enter into other financial obligations relating to the wastewater system as provided in the City Charter, Colorado State Statute and the Constitution of the State of Colorado. 13.02.040 Inconsistency with state statutes.
Any inconsistency between this chapter and the statutes of the state of Colorado is intended by the City Council. This chapter is enacted pursuant to Article XX, Section 6 of the Colorado Constitution, and to the extent of any such inconsistency, this chapter shall supersede such statutes. 13.02.050 Prior actions.
All action not inconsistent with the provisions of this chapter heretofore taken by the city or its officers and otherwise directed toward the authorization of the wastewater enterprise to have and exercise certain powers in furtherance of its purposes is hereby ratified, approved and confirmed.
