CONDUCT AND SUPERVISION OF MINORS

9.20.010    Curfew for minors.

9.20.020    Possession of cigarettes or other tobacco products by any person under 18 years of age is prohibited.

9.20.030    Possession or consumption of ethyl alcohol by underage persons is prohibited.

9.20.010 Curfew for minors.

(a) For purposes of this section, “minor” shall mean any person under the age of 18 years.

(b) It is unlawful for any minor to be or remain on any street, alley, park, public place, or establishment open to the public after the hour of 11:00 p.m. on any Sunday, Monday, Tuesday, Wednesday or Thursday, or after the hour of 12:00 midnight on any Friday, Saturday or legal holiday, or before the hour of 5:00 a.m. on any day, except:

(1) When accompanied by a parent, guardian or other person 21 years of age or older having the permission of the minor’s parent or guardian to have care or custody of the minor;

(2) When engaged in lawful employment;

(3) When traveling to or from: the minor’s place of employment; a religious service, meeting or activity; or a school-sponsored meeting or activity; or

(4) When upon an emergency errand directed by his or her parent, guardian or other person 21 years of age or older having the care or custody of the minor.

(c) It is unlawful for any parent, guardian or other person having care or custody of a minor to allow or permit such minor to violate any provision of subsection (b) of this section.

(d) Any minor served with a citation under this section shall appear in municipal court accompanied by the minor’s parent or legal guardian.

(e) Any person found convicted of violating this section shall be punished by a fine of not less than $25.00 nor more than the maximum penalty set forth in GMC 1.05.090. [Ord. 822 § 2, 2014; Ord. 808 § 1, 2014; Ord. 670 § 1, 2006. Code 1999 § 11-6-1].

9.20.020 Possession of cigarettes or other tobacco products by any person under 18 years of age is prohibited.

(a)(1) Possession or use of cigarettes or other tobacco products by a person who is under 18 years of age in the town of Granby is hereby prohibited.

(2) A law enforcement officer shall seize any cigarette or other tobacco product involved in any violation under subsection (a)(1) of this section committed in his/her presence.

(3) It shall not be an offense under subsection (a)(1) of this section if the person under 18 years of age was acting at the direction of an employee of a governmental agency authorized to enforce or ensure compliance with laws relating to the prohibition of the sale of cigarettes and other tobacco products to minors.

(4) It shall not be an offense under subsection (a)(1) of this section if such use or possession by a person under 18 years of age was in his/her legal residence and such use was permitted by that person’s parent or legal guardian.

(b)(1) No person who is under the age of 18 years of age shall purchase or attempt to purchase any cigarette or other tobacco products within the town limits of Granby.

(2) It shall not be an offense under subsection (b)(1) of this section if the person under 18 years of age was acting at the direction of an employee of a governmental agency authorized to enforce or ensure compliance with laws relating to the prohibition of the sale of cigarettes and other tobacco products to minors.

(c) As used in this section, unless the context otherwise requires:

“Cigarette” shall have the same meaning as set forth in Section 39-28-202(4), C.R.S.

“Possession” means that a person:

(1) Has or holds any amount of cigarettes or other tobacco products anywhere on his or her person;

(2) Owns or has custody of cigarettes or other tobacco products; or

(3) Has cigarettes or other tobacco products within his or her immediate presence and control.

“Tobacco product” shall have the same meaning as set forth in Section 18-13-121(5), C.R.S.

(d) Penalties.

(1) Any minor served with a citation under this section shall appear in municipal court accompanied by the minor’s parent or legal guardian.

(2) Any person convicted of violating subsection (a)(1) or (b)(1) of this section shall be punished by a fine of not less than $25.00, nor more than $2,650. The court, upon sentencing a defendant pursuant to the violations listed in this subsection, may, in addition to or in lieu of any fine, order the defendant to perform useful community service, order the defendant to attend an approved tobacco cessation or education program, and/or approve a contribution to a charitable or nonprofit organization. 9.20.030 Possession or consumption of ethyl alcohol by underage persons is prohibited.

(a) It shall be unlawful to possess or consume ethyl alcohol by an underage person as set forth in C.R.S. § 18-13-122, which statute, as amended, is incorporated herein by this reference; provided, however, penalties shall be in accordance with subsection (b) of this section.

(b) Any violation of subsection (a) of this section shall be punished as provided in GMC 1.05.090. The municipal court judge may impose alcohol education classes and/or useful public service in addition to or in lieu of any penalty assessment. [Ord. 971 § 2, 2022].
