1.10.010 Boundaries of unincorporated areas to be fixed by the Board of Supervisors. Revised 8/24

Precincts established as provided by Iowa Code Chapter 49 shall be used for all elections, except where temporary merger or division of established precincts is specifically permitted by law for certain elections, and no political subdivision shall concurrently maintain different sets of precincts for use in different types of elections.

A. No precinct shall have a total population in excess of 3,500, as shown by the most recent federal decennial census.

B. Each precinct is contained wholly within an existing legislative district.

C. Precincts shall be composed of contiguous territory within a single county. The boundaries of all precincts shall follow the boundaries of areas for which official population figures are available from the most recent federal decennial census.

1.10.020 Certification to Secretary of State. Revised 8/24

County plans must be postmarked on or before Saturday, January 15, 2022, and submitted to the Secretary of State. The boundaries of all precincts in Black Hawk County shall be established and defined as set forth:

A. Barclay/Bennington/Lester/Dunkerton precinct shall consist of Barclay, Bennington and Lester Townships, including the incorporated city of Dunkerton.

B. Big Creek/Spring Creek/La Porte City precinct shall consist of Big Creek Township, including the incorporated city of La Porte City, and Spring Creek Township.

C. Black Hawk/Cedar Falls/Lincoln precinct shall consist of Black Hawk, Cedar Falls and Lincoln Townships.

D. Cedar/Poyner 2/Gilbertville precinct shall consist of Cedar Township, the unincorporated portion of Poyner Township south of Indian Creek Road, and all of the incorporated city of Gilbertville.

E. Eagle/Orange precinct shall consist of Eagle and Orange Townships.

F. Elk Run Heights precinct shall consist of the incorporated city of Elk Run Heights.

G. Hudson precinct shall consist of the incorporated city of Hudson.

H. Mt. Vernon precinct shall consist of Mt. Vernon Township.

I. Poyner Precinct One/East Waterloo/Raymond/Fox/Jesup precinct shall consist of the unincorporated portion of Poyner Township north of Indian Creek Road and Gilbertville Road, all of the incorporated city of Raymond, East Waterloo Township, all of unincorporated Fax Township, and that part of the incorporated city of Jesup lying within Black Hawk County.

J. Union/Washington/Janesville precinct shall consist of Union and Washington Townships, including that part of the incorporated city of Janesville lying within Black Hawk County. The election precincts of Black Hawk County shall include those city precincts of the incorporated cities of Cedar Falls, Evansdale and Waterloo, as follows:

A. The following election precincts are those established by the city of Cedar Falls with boundaries described in Ordinance No. 3003, passed on December 20, 2021:

Before the final adoption of the ordinance establishing the precincts, a public hearing must be held. This hearing must be advertised in advance, as required by the Open Meetings Law, Iowa Code Section 49.4. [Ord. 144 § 4, 2021; Ord. 114 § 3, 2011; Ord. 61 § 3, 2001. Code 2009 § 1-6-4.]

New precinct boundaries become effective Saturday, January 15, 2021 (Iowa Code Section 49.7). Publication of the ordinance codified in this chapter will be made prior to January 15, 2021, and when approval of Black Hawk County’s reprecincting plan has been received by the Iowa Secretary of State. Iowa Code Section 49.11 requires that the Board of Supervisors shall publish notice of changes to county precinct boundaries in a newspaper of general circulation published in the county at least once each week for three consecutive weeks. The series of publications shall be made after the changes in the precincts have been approved by the state commissioner of elections. The last of the three publications shall be made no later than 30 days before the next general election. A map showing the new boundaries may be used.
