12.30.010 Approach permits.
An approach permit is required to access onto city right-of-way.
A. An approach permit in city right-of-way shall be required for all driveways that access onto a public right-of-way.
B. The permit shall be issued by the city clerk within 10 days of receipt of a completed application.
C. The permit shall be issued prior to any work in the right-of-way.
D. The permit shall be required prior to issuance of building permits.
E. A permit fee will be established by resolution of the city council. [Ord. 228 § 1, 2016.]
12.30.020 Right-of-way permits.
A right-of-way permit is required before any work can be performed in city right-of-way.
A. A right-of-way permit is required before any work is performed in the city right-of-way. “Work” includes, but is not limited to, road construction, utility installation, boring for utilities, construction of driveway approaches, etc.
B. The permit shall be issued by the city clerk with 10 days of the receipt of a completed application, and is required for any work done in the city of Donnelly’s right-of-way.
C. The city may require financial guarantees before allowing right-of-way work to be performed.
D. A permit fee will be established by resolution of the city council.
E. The applicant will be required to reimburse the city for any engineer expenses incurred as a result of issuing the permit or inspecting and/or completing the work in the right-of-way. [Ord. 228 § 2, 2016.]
12.30.030 Violations – Penalties.
Each violation of this chapter, or any permit issued hereunder, shall be considered a separate violation and each day of violation shall be a separate violation. Each person, whether acting as the principal or agent, violating this chapter or the conditions of the permit shall be responsible for the criminal penalties as set forth herein. Each violation of this chapter or permit shall be a misdemeanor punishable by a fine or imprisonment, or both, punishable in accordance with provision of Idaho Code, Section 18-113. 12.30.040 Separate violations.
Each violation of this chapter or permit shall be considered a separate violation and each day of the violation shall be a separate violation. Each person, whether acting as the principal or agent, violating this chapter or the conditions of the permit shall be responsible for the violations civilly as set forth herein. Each violation of this chapter or permit shall be punishable by a civil penalty not to exceed $1,000 per day or per violation whichever is greater. [Ord. 228 § 4, 2016.]
