MOTION PICTURES AND THEATRICALS

5-80-080 Building requirements.
5-80-010 License required.
It is unlawful to give, present or conduct any motion picture or theatrical production for admittance to which a fee is charged, or make videos and television shows, without having first secured a license therefor as is herein provided. (Ord. 3316 § 2 (part), 2015: prior code § 5-8-1)
5-80-020 Applications.
Applications for such licenses shall be made in conformance with the general provisions relating to such applications, and shall state in addition to the other information required the place of the intended performance and the seating capacity thereof. (Prior code § 5-8-2)
5-80-030 Fee.
Any person securing an annual license for motion pictures, naming a specific place or building in which the performances are to be presented, may present therein any number of performances, including theatricals, during the year for which the license was secured without having to pay any additional fee. The annual fee for such licenses shall be two thousand five hundred dollars ($2,500.00). (Ord. 3316 § 2 (part), 2015; Ord. 1921 (part), 1972; prior code § 5-8-3)
5-80-040 Unlicensed premises.
For motion pictures or theatricals which are to be presented in premises which are not covered by such an annual license, the fee to be paid shall be twenty-five dollars ($25.00) per day; provided that no such motion picture or theatrical shall be presented in or on any premises or building which does not fully comply with the requirements for the construction or maintenance of buildings for this purpose. 5-80-050 Prohibited pictures.
It is unlawful to offer or present any motion picture which has a tendency to cause a riot or public disturbance of the peace, or any immoral, indecent or blasphemous picture or performance. (Prior code § 5-8-5)
5-80-060 Crowding—Order.
It is unlawful to permit any person, excepting ushers or other theater employees, to remain standing in a hall or room in which a motion picture is presented; and it is unlawful to admit to any such hall more persons than can be accommodated by the seating arrangements for the premises. 5-80-070 Scenery.
It is unlawful to use any scenery in any theater other than noninflammable scenery of such as shall have been rendered noninflammable by application of fire preventive coatings. (Prior code § 5-8-7)
5-80-080 Building requirements.
It is unlawful to present any public motion picture in any building or structure which does not contain the number of exits required by the provisions of this code or by statute for buildings or places intended for motion picture performances, or in premises in which the electric wiring does not fully comply with the provisions of this code. All places used for the exhibition of theatricals must be kept adequately ventilated during the performances and for so long a time as the audience may remain therein. (Prior code § 5-8-8)
