1.20.010 Penalties for offenses and misdemeanors designated.

A. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the ordinances of the village of Riverdale shall be guilty of an offense. Except in cases where different punishment is prescribed by any ordinance of the village, any person convicted of an offense under the ordinances of Riverdale shall be punished by a fine of not less than fifty dollars nor more than the mandatory statutory limit as enacted by the State Legislature.

B. Where violation of any ordinance is made a misdemeanor, any person convicted of violating such ordinance shall be punished by imprisonment not to exceed six months, or by a fine not less than thirty dollars nor more than five hundred dollars, or by both such fine and imprisonment.

C. Each such person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinances of Riverdale is committed, continued or permitted by any such person, and he shall be punished accordingly.

D. The village attorney and/or village prosecutor is hereby empowered to file a civil action to recover any penalty or fine for the violation of any ordinance contained in this code. Pursuant to 65, Section 5/1-2-9.1 of the Illinois Compiled Statutes, in all actions for violations of the Municipal Code of the village of Riverdale wherein the fine for said violation would not be in excess of two hundred dollars and no jail term could be imposed, service of summons may be by certified mail, return receipt requested, whether service is to be within or without the state.

Any violations of the Municipal Code of the village wherein the fine for said violation would be in excess of two hundred dollars is excluded.

The penalty or fine for violation of said ordinances shall be increased to two hundred dollars in the event same is not paid within 60 days from the date of issuance and no jail term shall be imposed for the same. The village attorney and village prosecutor are authorized to settle said matters in accordance with the following schedule:
