PROCESSIONS AND PARADES

10.110.010 Permits.
A. No procession or parade, excepting a funeral procession, forces of the U.S. Army and Navy, the military forces of the state and forces of the police department and the fire department of the village shall occupy, march or proceed along any street except in accordance with a permit issued by the village administrator or his/her designee in conformity with such other regulations as are set forth in this chapter. Nothing in this section shall apply to processions or parades which utilize the sidewalks rather than the streets.
B. A person seeking issuance of a parade permit shall file an application with the village administrator on forms provided by said village administrator for such purpose. Such application shall be filed not less than ten days nor more than three hundred sixty-five days before the date on which it is proposed to conduct the parade. The application for a parade permit shall set forth the following information:
1. The name, address and telephone number of the person seeking to conduct such parade.
2. If the parade is proposed to be conducted for, on behalf of or by an organization, the name, address and telephone number of the headquarters of the organization, and of the authorized and responsible heads of such organization.
3. The name, address and telephone number of the person who will be the parade chairman and who will be responsible for its conduct.
4. The date when the parade is to be conducted.
5. The route to be traveled, the starting point and the termination point.
6. The approximate number of persons who, and animals and vehicles which, will constitute such parade; the type of animals and description of the vehicles.
7. The hours when such parade will start and terminate.
8. A statement as to whether the parade will occupy all or only a portion of the width of the streets proposed to be traversed.
9. The location by streets of any assembly areas for such parade.
10. The time at which units of the parade will begin assembly at any such assembly area or areas.
11. The interval of space to be maintained between units of such parade.
12. If the application for a parade permit is made by an agent rather than the individual responsible for the parade, the applicant shall file with the village administrator authorizing the agent to act on behalf of the applicant. This provision shall not apply to a duly authorized officer of an organization which complied with this subsection.
13. Any additional information which the village administrator shall find reasonably necessary to fairly evaluate as to whether a permit should issue.
14. The applicant will provide the village administrator with evidence of public liability insurance insuring the sponsor and naming the village as an additional insured with the following minimum coverages: bodily injury, including death/occurrence/aggregate, three hundred thousand dollars; property damage, fifty thousand dollars/occurrence/aggregate, except that insurance shall not be required for residential block events. Insurance required by this section shall be written by an admitted carrier licensed to do business in the state and having at least a B+ first division of ratings and a VI second division of ratings as listed in Best Insurance Guide, latest edition.
C. The village administrator or his designee shall approve or disapprove all applications for parade permits in writing. A parade permit shall be issued if it is found that:
1. The conduct of the parade will not substantially interrupt the safe and orderly movement of pedestrian and vehicular traffic on and contiguous to its route or unreasonably interfere with the rights of other persons who utilize the public ways.
2. The conduct of the parade will not tend to cause or promote a breach of the peace, cause injury to persons or property, provoke disorderly conduct or create a public nuisance.
3. The purpose of the parade is not unlawful.
4. The conduct of the parade will not unreasonably affect or interrupt business and commerce within the area to be traversed.
D. The village administrator may alter the proposed route or change the hours requested if such alterations or changes are necessary to meet the foregoing standards.
E. The village administrator will report to the village board on the decision as to each application for a parade permit. A denial of an application for a parade permit may be appealed in writing to the village board within a reasonable time after its denial.
F. The chairman of the parade who accepts a permit thereby consents to the formation of a contract between the sponsor and the village for payment of costs for the provision of village services and equipment.
G. The chairman of the parade shall deposit with the village seven days prior to the date of the parade, twenty-five percent of the cost estimated by the village administrator of the direct and reasonable costs incurred by the village to provide additional police and public works service for the parade. The village will send the sponsor a bill for the actual amount of the additional police and public works services incurred within twenty-one days of the conclusion of the event. Within fourteen days after the date of the bill, the chairman shall pay to the village the direct and reasonable costs incurred by the village to provide additional police and public works services for the special event, less the twenty-five percent deposit paid by the sponsor.
H. Incident to the conduct of a parade for which a permit has been issued, the village shall provide such services and only such services as are deemed necessary by the village administrator to promote public safety and order.
I. Any person convicted of violating any of the provisions of this chapter or the regulations promulgated pursuant thereto shall be fined not less than one hundred dollars nor more than the statutory maximum for ordinance violations. (Ord. 2007-21 § 1, 2007)
