32.01 BONDS OF OFFICERS AND EMPLOYEES.

(A) The Clerk-Treasurer is hereby authorized to purchase a blanket bond or a crime insurance policy endorsed to include faithful performance to cover the faithful performance of all employees, city officials, commission members, and persons acting on behalf of the city.

(B) The amount of the bond shall be not less than $15,000, nor more than $300,000.

32.02 MAYOR.

The Mayor is the city executive and head of the executive branch. He or she shall faithfully perform the duties and responsibilities contained in I.C. 36-4-5 and other Indiana statutes.

32.03 CLERK-TREASURER; OFFICE AS OFFICIAL REPOSITORY; RESPONSIBILITIES.

(A) The Office of the Clerk-Treasurer is designated as the repository of the officials records, books, accounts, ordinances and resolutions of the city.

(B) It shall be the duty of the Clerk-Treasurer to keep account books and financial records and make all disbursements in accordance with procedures set out and recommended by the State Board of Accounts and any other applicable state or federal rules, regulations, or law, and any applicable ordinances.

(C) It shall be the duty of the Clerk-Treasurer to keep on file all duly passed and adopted ordinances of the city. The Clerk-Treasurer shall designate at least 1 book as the Master Code of Plymouth, and shall, as soon as practicable, place among its pages the text of all ordinances passed by the Common Council and as submitted by the City Attorney, since the last codification. The Clerk-Treasurer shall by delineation strike out any title, chapter, or sections that have been repealed by the Common Council and shall make appropriate notations referring to the ordinance number and date of passage of any such repeal or amendment.

(D) (1) It shall be the duty of the Clerk-Treasurer, in consultation with the City Attorney, to at least annually submit to a reputable codification service the text of all ordinances passed since the date of the last codification for the purpose of obtaining from said service up-dated inserts for the Code of Plymouth.

(2) Additionally, the Clerk-Treasurer shall maintain a list of names and addresses of all known persons or entities that possess the Code of Plymouth. Upon receipt of any up-dated inserts for the Code of Plymouth, the Clerk-Treasurer shall mail or deliver to those so listed the referred to inserts for the purpose of updating the Code.

32.04 CITY ATTORNEY.

(A) The Law Department, as referred to in § 33.001(K), shall have as its department head the City Attorney as duly appointed by the Mayor pursuant to applicable to Indiana law and § 33.002(A)(6). The City Attorney shall serve as the exclusive legal counsel for the Executive Branch of city government. No department head as set forth in § 33.002(A)(1) through and including § 33.002(A)(8) shall employ legal counsel without the prior written consent of the City Attorney. However, the statutory boards or commissions delineated in § 33.002(B)(1), (2), and (3) shall have a right to employ legal counsel separate from the City Attorney but limited by applicable state law. Also, the Board of Public Works & Safety shall have a right to employ legal counsel separate from the City Attorney, but limited by applicable state law. Furthermore, the Common Council shall likewise have a right to employ legal counsel separate from the City Attorney but limited by applicable state law, if any.

(B) In addition to the responsibilities assigned to the City Attorney by state statute and the terms and conditions of any existing contract between the city and the attorney, he or she shall also do the following:

(1) The City Attorney shall draft and submit, within a reasonable time, to the Common Council for its consideration all proposed ordinances prepared at the direction of the Mayor, or shall review for the legality of its content any proposed ordinances submitted to the Common Council for its consideration by any other person or entity. In the latter instance of reviewing the legality of the contents of any proposed ordinance submitted by any person or entity, the City Attorney shall file with the Common Council, within a reasonable time, but prior to the first reading of said ordinance, a written report detailing the legal opinion of the Department of Law.

(2) Prior to the third and final reading of any proposed ordinance, the City Attorney shall attach to said ordinance an exhibit for Common Council consideration of the proposed text, including the numbering of the title, chapter, and section, that said ordinance would represent in the opinion of the City Attorney for inclusion in the Code of Plymouth. Upon passage and due attestation it is this text so submitted that shall become a part of the Master Code of Plymouth and ultimately incorporated in any subsequent update to the codification process of the Code of Plymouth.

(3) It shall be the duty of the City Attorney, in consultation with the Clerk-Treasurer, to at least annually review and submit to a reputable codification service the text of all ordinances passed since the date of the last codification for the purpose of obtaining from said service updated insertions for the Code of Plymouth.

32.05 OFFICE OF HUMAN RESOURCES.

(A) There is hereby established an Office of Human Resources. The Office of Human Resources shall be headed by a Human Resource Director.

(B) The Human Resource Director shall be appointed by the Mayor. The Human Resource Director shall hold the position for so long as the Mayor shall desire.
