3.28.010 STATE STATUTES ADOPTED.
The Council hereby adopts the provisions of I.C. 36-7-14 and elects to be governed by such provisions, and specifically I.C. 36-7-14-1(b), in establishing and conducting the affairs of a redevelopment commission. (Ord. 16.04 § 1, passed 5-21-2012)
3.28.020 ESTABLISHED; MEMBERSHIP.
Pursuant to I.C. 36-7-14-3, the Council hereby establishes the Department of Redevelopment (the “Department”) for the purposes of and to exercise the powers set forth in the Act or otherwise granted by law. The Department will be controlled by a board of five members to be known as the Redevelopment Commission (the “Redevelopment Commission”), three of whom shall be appointed by the Mayor and two of whom shall be appointed by the Council. The Council shall make its appointments by separate resolution. (Ord. 16.04 § 2, passed 5-21-2012)
3.28.030 JURISDICTION.
Pursuant to I.C. 36-7-14-1(c), all areas needing redevelopment, economic redevelopment areas, or allocation areas previously established under I.C. 36-7-15.1-37 through 36-7-15.1-58 are subject to the jurisdiction of the Redevelopment Commission and not subject to the jurisdiction of the Metropolitan Development Commission of Marion County, Indiana. 3.28.040 TERMS.
Each initial commissioner, appointed in 2012, shall serve from the date of appointment to January 1, 2013. Each commissioner appointed thereafter shall serve a one-year term from the first of January after their appointment and until their successor has been appointed and qualified. Any vacancy shall be filled in the same manner as the original appointment, and the successor shall serve the remainder of the vacated term. (Ord. 16.04 § 4, passed 5-21-2012)
3.28.050 MEETINGS.
The Redevelopment Commission shall meet not later than 30 days after they are appointed, organize and otherwise proceed to conduct and accomplish the necessary and appropriate redevelopment activities, functions and services of the Redevelopment Commission as provided by law. 3.28.060 POWERS AND DUTIES.
The Redevelopment Commission exercises supervision and control over the Department of Redevelopment. The Commission also makes recommendations to the Common Council to approve or disapprove claims as related to Redevelopment. In addition the Commission performs all other duties and functions as prescribed by state statute or City ordinance. (Ord. 16.04 § 7, passed 5-21-2012)
3.28.070 Funds.
The Common Council of the City of Southport establishes the following accounting funds for the RDC:
(A) Fund No. 243 – RDC Capital Fund – for the receipt of funds from bond proceeds and sale of assets held by the RDC and for disbursements including purchase of capital assets (and expenses associated with said purchases), capital improvements (and expenses associated with said improvements) and infrastructure improvements (and expenses associated with said improvements) as may be approved by the budget process. This shall be a perpetual fund, specifically for the RDC, until terminated by a subsequent ordinance. The disposition of any remaining funds at that time will be determined by their origin and Indiana Code pertaining to the origin of the said funds and their use.
(B) Fund No. 245 – RDC General Fund – for the receipt of funds from tax incremental financing (TIF) and other miscellaneous receipts and for disbursement of expenses in the ordinary course of conducting business as the RDC as may be approved by the budget process. This shall be a perpetual fund specifically for the RDC, until terminated by a subsequent ordinance. The disposition of any remaining funds at that time will be determined by their origin and Indiana Code pertaining to the origin of the said funds and their use.
(C) Fund No. 248 – RDC Bond Fund – for the receipt of funds established in the annual City budget for the repayment of an RDC general obligation bond and for the disbursement of principal and interest for the repayment of an RDC general obligation bond as may be approved by the budget process. This shall be a perpetual fund specifically for the RDC, until terminated by a subsequent ordinance. The disposition of any remaining funds at that time will be determined by their origin and Indiana Code pertaining to the origin of the said funds and their use. (Ord. 13.12.02, passed 12-16-2013)
