5.05.010 STORM WATER MANAGEMENT ACT ADOPTED.
Pursuant to IC 8-1.5-5-4(b), the Common Council hereby adopts the provisions of IC 8-1.5-5 et seq. (the “Storm Water Management Act”) for and on behalf of the City. (Ord. 15.09.01, passed 10-28-2015)
5.05.020 WITHDRAWAL FROM COUNTY STORM WATER MANAGEMENT DISTRICT.
Pursuant to IC 8-1.5-5-32, the Common Council hereby withdraws the City from the Marion County Storm Water Management District. (Ord. 15.09.01, passed 10-28-2015)
5.05.030 CITY STORMWATER MANAGEMENT DISTRICT ESTABLISHED.
Pursuant to IC 8-1.5-5-5, the Common Council hereby establishes the City of Southport Stormwater Management District (the “District”), for the purposes of exercising all powers set forth in the Storm Water Management Act and all additional powers otherwise provided or allowed by applicable law. 5.05.040 RESPONSIBILITIES, DUTIES, POWERS.
Pursuant to IC 8-1.5-5-4(b), the Department of Stormwater Management shall be and is hereby created for the purposes of providing for the collection, disposal and drainage of storm surface water in the City. The responsibilities, duties, powers and procedures of the Department shall be as set forth in the Storm Water Management Act, as amended from time to time. (Ord. 15.09.01, passed 10-28-2015)
5.05.050 COUNCIL RESPONSIBILITIES.
Pursuant to IC 8-1.5-5-4(g) and IC 8-1.5-3-3(a), the control of the stormwater facilities in the District shall be vested in the Common Council, which shall act for all purposes as the Board of the District under the Storm Water Management Act and for all other purposes under applicable law. 5.05.060 BUDGET.
The Common Council shall prepare a budget for the operation of the Department on an annual basis which budget shall be subject to approval along with other departments of the City. (Ord. 15.09.01, passed 10-28-2015)
5.05.070 TAXING DISTRICT.
Pursuant to IC 8-1.5-5-5, the District shall constitute a special taxing district which shall include all of the territory within the corporate boundaries of the City for the purposes and with the powers set forth in the Storm Water Management Act and as otherwise provided or allowed by applicable law.
