5.20.020    Illicit connections and illicit dumping

5.20.010 SUMP PUMPS.

(A) Sump pumps installed to receive and discharge groundwater or other stormwater shall be connected to the storm sewer or connected to a sub-surface drain. When storm sewers or acceptable subsurface drains are not available, the sump pump may discharge to a watercourse as approved by the City. A sump pump discharge pipe, which outlets onto the surface of ground, shall have its point of discharge outside the boundaries of any drainage or utility easement and no closer than 25 feet from any street right-of-way line. Discharge pipes directed toward or into an open drainage swale or ditch shall provide sufficient separation distance to provide sufficient area for reasonable absorption of water into the soil without creating erosion control problems. Sump pump discharge pipes shall not direct water on to adjoining lots or parcels.

(B) Sump pumps shall not be connected to street drains unless authorized by the Board of Public Works and Safety. (Ord. 2024.06, passed 6-17-2024)

5.20.020 ILLICIT CONNECTIONS AND ILLICIT DUMPING.

(A) Illicit connection, dumping, and discharge violations. Any person found to be in violation of this chapter shall be subject to the fine set forth in Chapter 5.08, Stormwater discharge, for each violation, and further shall be responsible for the cost of cleanup or correction of the prohibited action. If the responsible person has not taken corrective action within 10 calendar days after notification of a violation, then the City or its designee may take whatever action is necessary to clean up or correct the prohibited act, with the cost to be taken as a lien against the property from which the violation originated to the extent allowed under applicable law.
