2.28.010 Purpose.

The purpose of the joint traffic department is to install and maintain uniform signs, pavement markings, and traffic signals for the city of Evansville and Vanderburgh County. This department will maintain the ongoing traffic volume count program and investigate all traffic hazard complaints. This department shall also fulfill and satisfy all duties and responsibilities delegated to the department according to applicable statute, ordinance, or rule. It is intended that the transportation planning for the city of Evansville and Vanderburgh County be carried out where applicable by the joint traffic department. The design and construction geometrics and specifications shall be provided for the joint traffic department by the Evansville city engineer’s office.

2.28.020 Duration.

The agreement set forth in this chapter is for a period of three years and shall be automatically renewed for periods of three years, unless either party hereto gives the other party written notice of its intent to terminate this agreement. This written notice shall be received by the other party no later than one year before the expiration or termination of this agreement.

2.28.030 Organization.

A.    The joint traffic department shall be directed by a traffic director. The department may consist of seventeen (17) people and the organization of the department is as follows. There shall be three divisions: division of signs and marking, a division of administration, and a division of traffic signals.

1.    In the division of signs and marking, there may be seven full-time employees and four part-time employees. The division of signs and marking may be under the supervision of a shop foreman and under his supervision there may be two sign maintenance personnel, three painters, and one full-time laborer. There may also be provisions for four part-time summer laborers.

2.    The division of administration may consist of two persons. The two persons may be a secretary and a traffic counter.

3.    The division of traffic signals may consist of three persons. The three persons may be a chief electrician, an electrician, and an electrician’s aide. The division of traffic signals may be supervised by the chief electrician; the division of administration may be supervised by the traffic director.

B.    The traffic director shall report to the safety board. The traffic director shall also enter into coordination agreements with the area plan commission and the Evansville city engineer’s office. The area plan commission shall provide research, analysis, and preliminary design analysis for the traffic director in the fulfillment of his duties. The safety board shall review the operation of the joint traffic department. Where applicable, the Evansville board of public works shall coordinate with the safety board, the area plan commission, and the Evansville city engineer’s office to provide assistance necessary for the traffic director to fulfill his duties.

C.    The operation of this department shall be supervised by the Evansville board of public works, and shall be generally overseen by the Evansville board of public works.

2.28.040 Financing.

The joint traffic department may be financed as follows. The city of Evansville may contribute eighty-six (86) percent of the budget of this department. Vanderburgh County may contribute fourteen (14) percent to the budget of this department. The budget for this department shall be submitted to both the Evansville common council and the county council. The city and county councils or a committee of these councils shall meet in concert for the consideration of the budget, or an amendment thereto, of this department. The county may transfer the fourteen (14) percent to the city controller. The city controller shall recognize vouchers only according to the procedure set out for cities of the second class in the paying of vouchers, and only according to the budget as passed by the county and the Evansville common council.

2.28.050 Property ownership and termination.

A.    All property transferred by each of the parties shall be cost accounted and the party transferring the property shall retain title thereto. The joint traffic department shall have the right to the use and possession of the property. On termination, the party transferring the property shall have the property returned to them or be credited with the value of the property less depreciation.

B.    All new property purchased shall be owned jointly by the parties in the percentage that each party contributes to the budget. The city of Evansville, which contributes eighty-six (86) percent of this budget, is the owner of eighty-six (86) percent of the new property of this department. Vanderburgh County, which contributes fourteen (14) percent of the budget of this department, is the owner of fourteen (14) percent of the new property of this department.

C.    In the event of the termination of the agreement set forth in this chapter, the parties shall by appropriate means, distribute the new property of the department on the basis of percentages set out above, and the value of the property shall be the actual cash value of the property. Appropriate means shall include, but not necessarily be limited to, one party buying the interest of the other party in the properties of the department, or a sale of the properties, either in total or in part. All properties to be transferred on the termination of this agreement, shall be first appraised by three disinterested appraisers as appointed by the superior or circuit court of Vanderburgh County, and the procedure for the appraisal shall follow the procedure as established by the city of Evansville for the sale of surplus property.

2.28.060 Amendment.

This chapter may be amended in total or in part. The amendment shall be made a part hereof, and added to this chapter as an addendum of this chapter; however, the budget of the joint traffic department and the percentage allocation of the respective parties shall be reviewed by the parties annually in the preparation of the budgets of the city of Evansville and Vanderburgh County.
